Each m, tropotitan county <br />shall, and each county in which is located a disDosal facility <br /> <br />5 may., enforce this prohibition and may ~mpoae 9e~alties and <br /> <br />6 recover attorney fees' and court costs to the same extent as for <br /> <br /> enforcement of a desiqnation ordinance unde~ section 115A.86, <br /> <br />subdivision 6. The commissioner of the pollution control agency. <br />may enforce this section under section 115.071 or 116.072. <br /> <br /> Sec. 84. [METROPOLITAN DISPOSAL SITES; MORATORIUM; <br />REPLACEMENT SITING PROCESS; DISPOSAL PROHIBITION ENFORCEMENT <br />PLAN; STATEWIDE FACILITY SITING PROCEDURES.] <br /> Subdivision 1. [MoRAToRIUM.] The met~opolita~ council and <br />each of the metropolitan counties shall discontinue all <br />activities under Minnesota Statutes, sections 473.149, <br /> <br />subdivision 2b; 473.803, subdivision la; 473.806; 473.831~ <br /> <br />473,833; and 473.840 related to the siting of mixed municippl <br />solid waste disposal facilities,'exce~t activities governed by <br />sections 85 to 87, <br /> <br />Subd. 2. [REPLACEMENT SITING PROCES~.] The seven <br />metropolitan counties, in consultation with the metropolitan <br /> <br />council and the office of waste management, ~hall develop a <br />specific process for si~_i~g and developinc a disposal facility <br />within the metropolitan area to accommodate all of the ash <br /> <br />produced or projected to be produced by facilities in operation <br />or planned to be in operation by August 1, 1996 that p~ocess or <br />will process mixed municipal solid waste generated in the <br />metropolitan area, and for siting and developing a.. mixed <br />municipal solid waste disposal facility within the metropolitan <br />area unless each county and the council agrees that a mixed <br />municipal solid waste facilitv will not be needed within the <br /> <br />next 15 years to adequately manage metropolit'an waste. The <br />counties shall desicn the sitinc process to avoid siting <br />facilities where those facilities could have rela~ivelv <br /> <br />necative impacts on scullers. The counties shall report the <br /> <br />Dro~osed process to the lecislative commission on waste <br /> <br /> <br />
