§ 5.12 Conditlons of premises c. tn any area the existence of ami' strucZure or part of any structure which because of fire, wind, or other natural disaster, or physical deterio,-mtion is no longer habitable as a dwelling, nor useful for an>' other purpose for which it ma>' h~ve been in~ended. d. In any area zoned for residential purposes, the existence of any vacant dwelling, garage or other outbuilding,unless such buildings are kept secure}y locked, windows kept glazed or neat}y boarded up and otherv~se protecu~d to prevent entrance thereto by vandals. ~.12.02 Powers of office. Whenever in the judgment of the health authority, zoning officer, or cl~ief of police (or such other officers as may be determined by the administrator/clerk), he finds upon investigation that a blight condition is being maintained or exists within the CiW of l~amsey and within the respective fields of supervision as hereinbefore set forth, they shall issue a written notice ~o the owner or occupant and require him to terminate and abate said blight condition or to remove such conditions or remedy such defects. Service of said notice shall be in person or by mail. If the premises are not occupied and the address of the owner is unknot, service on the owner may be had by posting a copy of the notice on the premises. If said blight condition is not abated within ten days of the date of issuance of said notice, the city of Scia] issuing said notice shall issue a code violation to the notified owner or occupant. 5.12.03 Abatement of nuisances by council If, ahar such service of notice, the part), or parties fail to abate the blight condition or make the necessa? repairs, alterations or chan~es in accordance v~lth the direction of ~he council, said council may cause such blight condition to be abated at the expense of the city and recover such expenditure, plus an additional 25% of such ex~penditure, either by ci~-i] action agmimst ~he person or persons served; or if such service has been had upon the o~mer or occupant, by ordering the administrator/clerk to extend such s~rn, plus 25% thereof as a specia] ~ ags~nst the prope.,~y upon which the blight condition existed and to ce?~, the smme to the count' auditor for collection in the manner as taxes and special assessments are certified and collected. 5.12.04 Pe~I~'..~ny person ~lolating an)' provision of this section is =~uilty of a misdemeanor and upon conv~ction shall be punished by a fine of not more than $500.00 or imprisonment for not more than 90 days or both. ~orlcal No~e Estmbllshed by Or& 78-9, Oczober 10, 1975. 5.13 5.13.01 ~v~ of recyclable m=r.e~=~ prohibi:ed.
