Commissioner Bauer discussed the case noting the conditional use permit had been adopted by <br />the Council contingent upon the overlay district being approved. <br />City Planner Anderson explained the conditional use permit was contingent upon the Ordinance <br />amendment becoming effective. The Ordinance would need to be published and then 30 days <br />after publication it would become effective. This timeline would allow for comments from the <br />public. <br />Chairperson Levine thanked those in attendance and encouraged them to attend next Tuesday's <br />City Council meeting. <br />5.01: Public Hearing: Consider Request for a Variance to the Ordinary High Water <br />Setback to the Mississippi River and to the Use of Municipal Services for the <br />Property Located at 14740 Bowers Drive NW; Case of Kevin Fluegel <br />Public Hearing <br />Chairperson Levine called the public hearing to order at 7:14 p.m. <br />Presentation <br />City Planner Anderson presented the staff report stating Kevin Fluegel was requesting a variance <br />to lot area, lot width, river setbacks, and connection to City services to facilitate the construction <br />of a single family home on the property located at 14740 Bowers Drive NW. The property is <br />located within the Critical River Overlay District and is subject to standards of the Critical River <br />Overlay District in addition to those found in the R -1 Residential District. Staff discussed the <br />case in detail and recommended approving the variance request, amending the lot area and lot <br />width. <br />Citizen Input <br />Kevin Fluegel, 14740 Bowers Drive NW, explained he was proposing to build a single family <br />home on the property that was in keeping with the size of the neighborhood. He requested his lot <br />be treated the same as the neighboring parcels. <br />Commissioner VanScoy questioned where the septic system would be located. <br />Mr. Fluegel was uncertain where this would be located at this time. <br />City Planner Anderson commented the septic system location would be determined at the time of <br />building permit application. He reported the septic system would have to be setback 75 feet from <br />the high water mark. <br />Motion by Commissioner VanScoy, seconded by Commissioner Maul, to close the public <br />hearing. <br />Planning Commission/February 6, 2014 <br />Page 3 of 7 <br />
