Motion by Commissioner Johnson, seconded by Chairperson Nixt to recommend that City <br />Council adopt Findings of Fact favorable to the applicant relating to Janis Day's request for a <br />home occupation permit. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Johnson, Brauer, Reeve, <br />Shepherd, Van Scoy and Watson. Voting No: None. Absent: None. <br /> <br />Motion by Commissioner Johnson, seconded by Commissioner Brauer to recommend that the <br />City Council approve Janis Day's request for a home occupation permit based on the findings of <br />fact. <br /> <br />Motion Carried. Absent: None. <br /> <br />Case #3 <br /> <br />Request for an Interim Use Permit to Allow Outdoor Storage of Commercial <br />Vehicles and Equipment on a Residentially Zoned Parcel; Case of Gerald <br />Bauer <br /> <br />Presentation <br /> <br />Associate Planner Wald explained that the City received a complaint in November of 2002, <br />reporting that Able Paving and Construction was storing their commercial vehicles and <br />equipment and possibly operating a branch office on the property located at 16130 Variolite <br />Street, also known as the St. Anthony Gun Club property. Associate Planner Wald indicated that <br />Gerry Bauer is the owner of the subject property, which is now called Ramsey Shooting Center. <br />Staff contacted Mr. Bauer on November 14, 2002 stating that the Ramsey Shooting Center is a <br />legal non-conforming use, however additional commercial activity on the subject property would <br />be a violation of City Code. She indicated that Mr. Bauer contacted City Staff and stated he is <br />leasing a portion of the subject property to Able Paving and Construction, who is utilizing the <br />property for outside storage of their commercial vehicles and equipment. She indicated Mr. <br />Bauer is requesting an interim use permit to allow for outside storage of commercial vehicles and <br />equipment on the subject property for approximately a 2-year period. Associate Planner Wald <br />advised it is Staff's opinion that the request to store commercial vehicles and equipment on the <br />subject property is not the most desirable use for the subject property. She indicated Staff is <br />concerned with the 6:00 a.m. starting time and the commercial nature of the business increasing <br />in activity during the summer months when construction is at its busiest time. Staff is also <br />concerned with mechanical work being performed on site and excess construction and paving <br />products being brought to the property. <br /> <br />Associate Planner Wald indicated that Staff is recommending denial of the request at this time. <br />She explained that Staff is of the opinion that the surrounding residential neighborhood could be <br />negatively affected by the increase in traffic and commercial vehicle noise that will be generated <br />by the nature of Able Paving's business, especially during the busy construction season.
