that Planning session (Several Council members spoke very supportive of why we should <br />be Residential - not E- listing the very same reasons why this makes sense as we had <br />found out from Realist Agents, Bank Officers, Insurance Agents, Mortgage Company's <br />and from friends we had outside the city. This without any contact from me) . There was no <br />one who spoke against our petition nor raised or proposed any other possible Zoning <br />category. The Council then passed a motion of support sending our petition to the <br />Planning Commission and directing staff to act accordingly. <br />The Planning Commission scheduled and held a hearing on our petition and then voted to <br />support our petition to rezone as Residential. There was no disagreement on our petition <br />issue presented by any persons present at the hearing or the actual Commission meeting <br />nor was there any other possible Zone category propose or discussed. (The members <br />even went so far right after the vote to agree to say how sorry they felt for all the trouble the <br />we property owners had been put through and that they hoped that the Council members <br />would agree also!) <br />The motion of support of our Residential Zone petition then went to the City Council where <br />a hearing was again scheduled. The Council hearing was held and again no persons rose to <br />oppose our Zoning position nor propose or discus any other Zoning Category. Only one <br />person rose to speak (This person had just recently purchased a home on the South side <br />of Rivlyn Ave) and spoke passionately in favor of the Residential Zoning. I and the others <br />who had submitted the petition did not rise because we had been assured that speaking <br />again was not necessary beyond what we had presented at the original petition <br />submission. The City Council Members then voted to accept the motion from the Planning <br />Commission without discussing any other Zoning categories or possible options that might <br />be applied to these properties. <br />So, those of us at this City Council Planning session went home with the assurance of staff <br />that we had done everything properly and that at the next Regular City Council meeting <br />(August 26,2003) our issue would be on the agenda and should pass. We trusted this <br />because, again 1 repeat, no other options or other Zone choices were presented to any of <br />us to consider or to discuss. <br />Now, we come to the Council meeting of August 26,2003. <br />I and several others from Rivlyn Ave - both North and South side - arrived early and were <br />again joined by representatives of the other properties South of Hwy. 10. During the <br />meeting no staff, Attorney or Council Member talked with me or anyone else from our <br />Rivlyn Ave issue. <br />Mayor Gamec even went to call a recess for 15 minutes after the Council had discussed <br />and decided to set up Council Meetings for September 2 and 4 - the only agenda item <br />would be the Town Center Project and if things for the Town Center were not ready the <br />meeting would be canceled. During this recess I and the others in attendance were <br />not approach nor talked with by any Council Member or staff. <br />Mayor Gamec reconvened the Council Meeting. The first item was the land on Riverdale <br />and surprise, surprise, just after the discussion began, Councilmen Cook spoke up with <br />the idea that this presently undeveloped land would be a possible good candidate for a <br />designation of "Mixed Use ". After very little discussion of this versus the Planning <br />Commissions motion of Residential or of splitting some of the property into E and the rest <br />to Residential a motion to send this property to a future Council Planning Session to look at <br />"Mixed Use" Zoning was made, seconded, and passed. <br />Then came the property South of Hwy. 10 at the West Boundary of the City of Ramsey <br />
