The Planning Commission asked Mr. Brenner if he has ideas of what can be done to make the <br />conservation easement easier. <br />Mr. Brenner stated he wants it as natural as possible and as many trees saved as possible so it is a <br />buffer. He stated he does not like conservation easements because they are both good and bad, <br />depending on how they are created because it is hard to maintain easements. <br />Community Development Director Gladhill stated the HOA sets up additional tools and because <br />of the concerns of the property owner, perhaps a barrier could be considered such as a <br />conservation easement owned by the HOA. In that case, the HOA would hold fee title and <br />maintain the property. <br />City Planner Anderson stated if a conservation easement, language would be needed to address <br />diseased and deceased trees. <br />Del Fredricks, 7550 158 Avenue NW, stated 158 Avenue and Traprock Street are adequate for <br />the existing 15 homes. He noted there is a park area that used to be a horse arena that shows a <br />road so that would be an option for a Variolite tie in without extending Traprock Street. <br />Commissioner Brauer asked if staff would be comfortable with direction to work out the <br />conservation easement with the developer to ensure the neighborhood's concerns are addressed. <br />Community Development Director Gladhill stated staff can work out a solution with a <br />conservation easement and Outlot A if so directed by the Planning Commission. <br />Commissioner Brauer recalled that Outlot A went all the way through, cutting the conservation in <br />half. He stated if the conservation easement extended all the way across, then it would solve the <br />problem of a road going through. <br />Community Development Director Gladhill stated that is a potential as it comes with restrictions. <br />Staff would be concerned whether utilities or a trail could be extended through a conservation <br />easement. He stated that can be added as another option as well. <br />Motion by Commissioner Bauer, seconded by Commissioner VanScoy, to recommend that City <br />Council adopt Resolution #14 -06 -101 granting Preliminary Plat approval of Country Club Hills, <br />contingent upon revisions as outlined in the Staff Review Letter dated May 30, 2014, elimination <br />of Outlot A and dividing it between the adjoining properties, providing an easement for utilities <br />and bike trail, and the applicant and City working together on a solution for the conservation <br />buffer and incorporating it into the final plat. <br />Further discussion <br />Planning Commission /June 5, 2014 <br />Page 11 of 16 <br />
