zone and the slope preservation zone. A water - oriented <br />accessory structure must not exceed 12 feet in height and 120 <br />square feet in area. The structure must be placed a minimum of <br />10 feet from the ordinary high water level. <br />Subpart 5. Landscaping, patios and retaining walls in non - riparian <br />residential yards in slope preservation zones. <br />A. Where non - riparian residential yards within the slope <br />preservation zone have been altered with lawns, gardens, and <br />similar landscaping, local governments may allow patios and <br />retaining walls up to (250 — 500) square feet to be constructed <br />in compliance with part 6106.0150, provided that: <br />(1) the slope is not abutting a bluff or part of a natural <br />d ra i nageway; <br />(2) the stability of the slope is maintained; <br />(3) the development will not result in erosion problems; and <br />(4) the site is not readily visible. <br />This new provision applies to existing <br />developed lots with yards in the Slope <br />Preservation Zone; based on local <br />government comments. <br />Seeking feedback on the threshold; ideally, <br />this threshold would match that for permit <br />requirements under the land alteration <br />standards in part 6106.0150 subp. 7. <br />Subp. 6. Private signs. Placement of signs is guided by the local <br />government's underlying zoning, with the following additional <br />provisions: <br />A. The local government may allow off - premise advertising signs, <br />provided that: <br />(1) the signs meet all required setbacks and height limits <br />standards of these MRCCA rules; and <br />(2) the signs are not readily visible. <br />B. The local government may allow directional signs for patrons <br />arriving at a business by watercraft, provided that the signs <br />(1) are consistent with Minnesota Statutes, chapter 86B; <br />This subpart describes the design and <br />placement of signs. <br />"Readily visible " — visible from the ordinary <br />high water level on the opposite site of the <br />river. <br />(2) if located within the shore impact zone, convey only the <br />location and name of the establishment and the general <br />types of goods and services available; <br />(3) are no greater than ten feet in height and 32 square feet in <br />surface area; and <br />(4) if illuminated, have lighting that is shielded to prevent <br />illumination out across the river or to the sky. <br />PART 6106.0150 VEGETATION MANAGEMENT AND LAND ALTERATION <br />STANDARDS <br />Subpart 1. Purpose. The purpose of this part is to establish standards <br />that: <br />A. sustain and enhance the ecological functions of vegetation; <br />B. preserve the natural character and topography of the MRCCA; <br />and <br />C. maintain stability of bluffs and very steep slopes; and ensure <br />stability of other areas prone to erosion. <br />This new part combines previous separate <br />parts on vegetation management, land <br />alteration, and bluffs and steep slopes.
