Employees who are convicted of a drug related violation in the workplace or while engaged in <br />work -related responsibilities may be required to participate in a drug abuse assistance or <br />rehabilitation program approved for such purposes by a federal, state, or local health, law <br />enforcement, or other appropriate agency. Appropriate personnel action shall be taken against <br />such convicted employee up to and including termination of employment. The City reserves the <br />rieht to terminate any employee who has been arrested for, pled guilty to, or convicted of anv <br />crime involving the operation of a motor vehicle under the influence of illegal drugs, alcohol, or <br />other controlled substances. This includes all such crimes occurring outside of work hours and <br />all such crimes involving the use of any vehicle owned or leased by the City, the employee's <br />personal vehicle, or any other vehicle within 30 days of receiving notico of s olavicti on. <br />Employees are also encouraged to attend one of the drug -free awareness programs which may be <br />offered periodically. General Policy: It is the policy of the City to provide a drug -free environment. The City's t - - Formatted: Font: Bold <br />goal is to establish and maintain a healthy and efficient workforce free from the effects of drug and <br />alcohol abuse in compliance with the requirements of the federal Drug -Free Workplace Act of 1988 <br />and other applicable stato law. <br />The City recognizes drug and alcohol abuse as potential health, safety and security problems. <br />Employees needing help in dealing with drug and alcohol problems are encouraged to make use of <br />the medical resources available through their health insurance plans. <br />employees are required to report to work on time and in appropriate mental and physical <br />condition for work. No employee shall be under the influence of any illegal drug, alcoholorr <br />other controlled substance while the employee is working, while the em_ployee is on the <br />employer's premises, representing the City away from the workplace during work hours,,or <br />operating the employer's vehicle, machinery or equipment, except to the extent authorized by a <br />valid medical prescription. <br />Unless specifically authorized as part of the employee's work duties, no employee shall use, possess, <br />manufacture, distribute, dispense, sell, or transfer drugs, alcohol, or drug paraphernalia while the <br />employee is workingfef while the employee is on the employer's premises, representing the City <br />away from the workplace during work hours, or operating the employees vehicle, machinery or <br />equipment, except to the extent authorized by a valid medical prescription. Off duty employees <br />may use or possess alcohol on City premises such as parks and parking lots when said use and <br />possession is not prohibited to members of the general public.
