7) That the amount of earth to be mined as requested by the applicant does not <br />require an Enviror~ental Assessment Worksheet as regulated by the Minnesota <br />Envirorm~ental Quality Board. <br /> <br />8) Adjacent vacant land will not be affected by the proposed use. <br /> <br />9) There is adequate assurance, guaranteed by performance bond in the amount <br />of $10,000, that the property will be left in suitable condition after the use <br />is terminated. <br /> <br />10) That based on plans as presented and based on the current average water <br />table in the area of the excavation, which is 864', when completed the average <br />grade of the subject property will be at least 7' above the water table. <br /> <br />11) Adjacent developed land will not be adversely affected by the proposed use <br />because of traffic, noise, dust, smoke, unsightliness. <br /> <br />].2) ~hat the applicant states that a 3 year time limitation on this temporary <br />conditional use permit is acceptable. <br /> <br />13) The period of time for which the Temporary Conditional Use Permit is to be <br />granted will terminate before any adverse effects are felt upon adjacent <br />property. <br /> <br />Council generally agreed to the findings of fact as prepared but Mayor Heitman <br />took exception to items 11 and 13. <br /> <br />Motion by Councilmember Sorteberg and seconded by Councilmember Reimann to <br />approve Items 11 and 13 being included in the findings of fact prepared <br />regarding Waste Management of Minnesota, Inc.'s request for a temporary <br />conditional use permit. <br /> <br />Motion carried. Voting Yes: Councilmembers Sorteberg, COx and Reimann. <br />Voting No: Mayor Heitman and Councilmember Schlueter. <br /> <br />Motion by Councilmember Sorteberg and seconded by Councilmember Reimann to <br />adopt Findings of Fact 0126 as prepared at this November 12, 1985 City Council <br />meeting and including Items 1-13, regarding Waste Management of Minnesota, <br />Inc.'s request for a temporary conditional use permit. (Please refer to <br />findings of fact file for Findings of Fact 0126). <br /> <br />Motion carried.
