In addition, Councilmember Cox <br />noted that the increased burden on the private septic syst~n could create a <br />need for municipal services in the neighborhood. <br /> <br />Motion by Councilm~r Sorteberg and seconded by Councilmember COx to adopt <br />Findings of Fact 0101 regarding Mr. Joseph Nyara's request for a conditional <br />use permit for a home occupation. <br /> <br />Motion carried. Voting Yes: Acting Mayor Reimann, Councilmembers Sorteberg, <br />Cox and Schlueter. Voting No: None. Absent: Mayor Heitman. <br /> <br />Motion by Councilmember Cox and seconded by Councilm~nber Sorteberg to approve <br />Mr. Joseph Nyara's request for a conditional use permit for a home occupation <br />at 5320 155th Lane NW, oontingent upon Mr. Nyara entering into a conditional <br />use permit with the City. <br /> <br />Motion carried. Voting Yes: Acting Mayor Reimann, Councilmembers Sorteberg, <br />Cox and Schlueter. Voting No: None. Absent: Mayor Heitman. <br /> <br />C. Request For Conditional Use Permit For Mining: Case Of Mr. Bud Sauter - <br /> <br />Mr. $chnelle noted that the proposed mining and grading permit agreement <br />included in the agenda has been revised and Council has been provided with <br />copies of the revised agreement. <br /> <br />City Attorney Goodrich reviewed the revised permit agreement with Council. <br /> <br />Mr. Bud Sauter stated that he would like some time to review the revised permit <br />agreement. Mr. Sauter stated that he also is reluctant to agree to bonding for <br />restoration as the permit agre~nent requires proper restoration. <br /> <br />Motion by Councilmember COx and seconded by Councilmember Sorteberg to table <br />Mr. Bud Sauter's request for a conditional use permit for grading and mining in <br />order to allc~ Mr. Bud Sauter time to review the ravised agreement and to place <br />Mr. Bud Sauter's request on the next Council agenda; further, that Staff should <br />notify Mr. Sauter accordingly if there will be a Council meeting prior to May <br />28, 1985. <br /> <br />Motion carried. Voting Yes: Acting Mayor Reimann, Councilmembers Sorteberg, <br />Cox and Schlueter. Voting No: None. Absent: Mayor Heitman. <br /> <br />D. Request For. Metes And Bounds Subdivision: Case Of Mr. Lauren Wetterlind - <br /> <br />Mr. Wetterlind was present. <br /> <br />Councilmember Cox noted that the subdivision proposes easements for the <br />extension of 159th; this would mean that these new parcels derived the benefit <br />from 159th without contributing towards it's construction. Also, according to <br />the Charter, the residents on the Wetterlind property could successfully oppose <br />improvements to 159th to serve the next parcel to the east of the Wetterlind's. <br />Councilm~mber Cox suggested that a contract be dra~n up to assure that 159th <br />can access that property to the east of Wetterlind's. <br /> April 23, 1985 <br /> <br />Page 11 of 18 <br /> <br /> <br />
