Mr. Scroggins was present and Ms. Norris explained that Mr. Scroggins is <br />requesting~a metes and bounds subdivision to split property on the west <br />side of C~y. Rd. #57 from property on the east side of Cty. Rd. #57. <br />Planning and Zoning has recommended approval. <br /> <br />Motion by Councilm~ber DeLuca and seconded by Councilmember Cox to approve <br />Mr. Walter Scroggins' request for a metes and bounds subdivision. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmsmbers Sorteberg, Cox, <br />DeLuca and Pearson. Voting No: None. <br /> <br />Requ_ est For Preliminary Plat _Approval Of Now And Then Estates: <br /> Case Of Mr. Paul Bertils: <br /> <br />Ms. Norris stated that Mr. Bertils' is requesting preliminary plat approval <br />of 40 acres located north of 167th Avenue and west of Cty. Rd. #5 to be <br />platted with 14 lots, each at least 2.5 acres in size. <br /> <br />Councilmember DeLuca noted that Planning and Zoning had concerns regarding <br />this case and Council direction regarding the number of accesses that <br />should be required to plats. <br /> <br />Councilmember COx stated that he would like at least a temporary second <br />access provided in the form of an easement across Lot 1 of Block 3 to be <br />used in emergency situations only. <br /> <br />Councilmember Sorteberg stated that he feels temporary second accesses will <br />attract use by recreational vehicles and cause problems. <br /> <br />Mr. Bertils stated that he felt it was a little late in the process to <br />require a second access. <br /> <br />Councilm~mber Cox stated that he feels it is not unreasonable to require a <br />temporary emergency access in cases where cul-de-sacs lengths exceed 600' <br />and do not access adjacent property. <br /> <br />Mr. Hartley suggested that such a temporary emergency access only be <br />maintained as needed in emergency situations as regular maintenance of it <br />will encourage regular use of the access. <br /> <br />Motion by Councilmember Cox and seconded by Councilmember DeLuca to approve <br />Mr. Paul Bertils' request for preliminary plat approval of Now and Then <br />Estates contingent upon: 1) compliance with Items 1-6 of the City Engineer's <br />letter dated March 3, 1987; 2) the developer providing a thirty foot <br />easement and culvert on Lot 1 of Block 3 that would access Cty. Rd. #5 to <br />serve as an emergency access. (Said easement shall be deeded back to the <br />appropriate property cwner upon develo~ent of the property north of Now <br />and Then Estates.); 3) development of 167th Avenue ~ between Cty. Rd. #5 <br />and Jaspar Street NW as a Municipal State Aid road. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Cox, Pearson <br />and DeLuca.
