prove Dayton to be an official crossing that the railroad had no legal <br />right to close. <br /> <br />Mr. Hartley replied that re-establishing a crossing through historical <br />records is a lengthy process. <br /> <br />Charles Weaver - Stated that he is one of the developers of Northfork and <br />suggested that the City Administrator be directed to find a temporary <br />solution to truck traffic routes if Council is going to take the time to <br />conduct a public hearing on the closing of the Puma crossing. <br /> <br />Mr. Hartley replied that MN/DoT and Burlington Northern have indicated that <br />there is no such thing as a temporary railroad crossing; to begin to use <br />the Dayton crossing would require making application and providing <br />documented action on the part of City Council indicating their willingness <br />to close the Puma crossing. <br /> <br />Acting Mayor Cox stated that City Engineer Raatikka should provide <br />information regarding MSA alignments and the extension of Cty. Rd. #116 to <br />this particular area. <br /> <br />Motion by Councilmember Pearson and seconded by Councilmember DeLuca <br />directing city staff to schedule a public hearing for 7:30 p.m. on <br />Wednesday, August 19, 1987 regarding the possibility of closing the Puma <br />railroad crossing and reinstating the Dayton crossing; notifying all <br />affected property owners in that area of the hearing; and schedule a <br />special City Council meeting following the hearing to consider a decision. <br /> <br />Motion carried. Voting Yes: Acting Mayor Cox, Councilmembers Sorteberg, <br />DeLuca and Pearson. Voting No: None. Absent: Mayor Reimann. <br /> <br />Dennis Peck - Stated he noticed a willingness on the part of Burlington <br />Northern amd Mn/DoT to work with the city and developers and urged the city <br />not to let this issue rest during the next week. <br /> <br />Motion by Councilmember Sorteberg and seconded by Councilmember DeLuca <br />directing that the following items be accomplished regarding the Puma and <br />Dayton railroad crossing exchange prior to the public hearing scheduled for <br />August 19, 1987: <br /> <br />1) City Engineer is authorized to apply for a permit for access onto <br /> U.S. Highway #10 NW from the Dayton crossing. <br /> <br />City Attorney is authorized to develop agreements with Burlington <br />Northern RR for right-of-way and the cost of constructing and <br />protecting the Dayton railroad crossing. <br /> <br />3) <br /> <br />City Engineer is authorized to develop proposed routing of a <br />frontage road connecting the Dayton crossing to U.S. Highway #10 <br />NW and routing of 153rd Avenue NW to the Dayton crossing. <br /> <br />Further Discussion: Councilmember DeLuca directed that retention of Puma <br />as an agricultural crossing be requested. <br /> City Council/August 11, 1987 <br /> <br />Page 8 of %6 <br /> <br /> <br />
