Mayor Reimann directed Mr. Hartley to begin talks with Elk River to negotiate <br />the cost of maintinenace, a maintenance plan, upgrade and future costs of <br />railroad protection for Jarvis Street. <br /> <br />Motion by Councilmember Cox and seconded by Councilmember DeLuca to proceed with <br />negotiations with Elk River for cost of maintenance, upgrade and future cost of <br />railroad protection for Jarvis Street. <br /> <br />Further discussion: Funding was considered and Mayor Reimann stated that if <br />signalization is required, it is his understanding that the City could use MSA <br />funds. <br /> <br />Motion carried. Voting Yes: Mayor Rehbein, Councilmembers Sorteberg, Cox, and <br />DeLuca. Voting No: None. Councilmember Pearson abstained. <br /> <br />Further Staff Instruction: <br /> <br />City Engineer to get quotes on upgrade of Jarvis <br /> Street. <br />Staff to meet with Mr. Rabine regarding truck <br /> haul routes. <br /> <br />As soon as Mr. Hartley gets information together, he will contact the Mayor and <br />will call a special meeting of the Council for discussion. <br /> <br />Case #3: <br /> <br />Discuss policy relating to impacts on Safety Zone B of the Airport <br />S~fety Zoning. <br /> <br />Mr. Hartley asked the Council to consider its policy that may apply to the areas <br />within Safety Zone B as it would relate to the cost of any future extension of <br />utilities into this area. Mr. Hartley stated that many property owners rely <br />upon the ability to resubdivide as a way of paying for public utilities if and <br />when they are extended into the area. <br /> <br />Mayor Reimann stated that consideration should be given to those in Zone B who <br />may not be able to subdivide their property. He suggested that the Council look <br />for a way to cut one-acre properties down to two lots but pay only one <br />assessment. Councilmember Cox agreed that there should be a provision for those <br />property owners in Zone B that would not be allowed to subdivide if the airport <br />zoning is adopted. <br /> <br />Mr. Hartley stated that if the Council wishes to take action on the Ordinance <br />that it may be done at this meeting. He stated that the Council should <br />consider: <br /> 1. option to establish a referendum <br /> 2. timing - when would be appropriate time to adopt ordinance <br /> <br />Motion by Councilmember Cox and seconded by Councilmember Pearson to prepare an <br />advisory election and referendum and move forward on it in a timely matter. <br /> <br />Councilmember DeLuca asked if the referendum needs to be held within 120 days. <br />City Attorney Goodrich stated that it does not but should be done as soon as <br />soon as possible. <br /> <br />Mr. Hartley explained the process for referendum and stated that the Council may <br />want to consider restating the motion to consider accurate dissemination of <br /> <br />City Council/August 25, 1987 <br /> Page 14 of 16 <br /> <br /> <br />
