follow through with it's previous motion to have an advisory election; if <br />that is not going to happen, then the motion should be rescinded. <br /> <br />Mr. Goodrich stated that an advisory election after the adoption of the <br />zoning ordinance is not appropriate; at that point it becomes a matter of <br />referendum or initiative. Council could have an advisory election on the <br />airport remaining private or becoming public. <br /> <br />Mr. Ippel noted that the airport zoning ordinance went through the public <br />hearing process in order to enact zoning; it should be enacted and the <br />public has the opportunity for initiative within their rights. An advisory <br />election should be on the issue of the city owning and possibly operating <br />an airport facility. That decision could be best made when all the facts <br />are in, which will be in the second quarter of 1 988 . <br /> <br />Councilmember Pearson inquired why zoning should be in place prior to a <br />decision being made on whether the airport will be improved and acquired. <br /> <br />Mr. Otto stated that the zoning is to protect the airport approach areas. <br />Once zoning is adopted, if somebody wanted to develop in Zone A, they would <br />submit a plans to the Planning and Zoning Commission and the Airport Zoning <br />Administrator. The Zoning Administrator would make a finding regarding <br />whether or not the proposed development is in violation of the zoning <br />ordinance. If it is in violation, the developer can request a variance <br />from the Airport Board of Adjustment and they would make a finding as to <br />whether or not that development can occur. <br /> <br />Mr. Hartley noted that it is very possible the Board of Adjustment would <br />approve the request if it were the kind of activity that is a low <br />investment and the kind that at some later date would be reasonable for the <br />city to acquire. If the amount of investment and the hazard proposed would <br />be sufficiently great, the Board of Adjustment might refuse the variance. <br />At that point, the making of the airport zoning would be that of a taking <br />of property to a sufficient degree that it would have to be purchased by <br />the local government. If the Council plans to make improvements to the <br />airport, then it is wise to adopt zoning and to protect land and airspace <br />use. If it is not Council's intention, zoning should not be established <br />because it will be costly in time and money. <br /> <br />Mr. Goodrich moted that enactment of an airport zoning ordinance does not <br />cause the airport to become improved and municipally owned nor does it <br />affect existing residences unless they want to expand. <br /> <br />Mr. Buchanan stated that he has no particular position with respect to the <br />airport but he would like one in Ramsey. He also noted that many of the <br />residents that are concerned with the airport issue are not present tonight <br />and the last indication Council gave them was that there would be an <br />advisory election. If Council adopts the zoning ordinance tonight, those <br />residents will be displeased, force a referendum and most likely it will <br />not pass under these circumstances.
