Motion by Councilmember Cox and seconded by Councilmember DeLuca authorizing City Staff to draft a resolution establishing a policy that will indicate it is not the responsibility of Ramsey's contracted vendors to provide professional services to the general public unless prior authorization is obtained from the City Administrator and/or City Council. Further Discussion: Councilmember DeLuca stated that the policy should also establish whether or not it is the responsibility of staff to determine if petitions for referendums submitted are in proper legal form. Councilmember Cox stated that making sure a petition is in property legal form is the responsibility of those persons submitting it. City Attorney Goodrich created a scenario of a petition not in proper legal form being submitted on the final day of the 30 day waiting period and inquired if the citizens have lost their opportunity for referendum because the 30 days has run out and there isn't time to redo the petition correctly. Councilmember Cox stated that it is the responsibility of persons creating the petition to have it reviewed by their own legal counsel to make sure it complies with Charter requirements. Mr. Hartley noted that the policy should also specify standard professional services that are provided by the city. Councilm~mber Cox stated that there are also many issues that the City Administrator has direction over and the city's budget makes it clear that great amounts of his time cannot be expended on explanations that are really the responsibility of the citizen to research. Case #5: Sewer And Water Alignment Options South Of U.S. Highway ~10: Mr. Raatikka stated that pursuant to Council direction, he has researched options for the sewer and water project south of Hwy. #10. Those options are: 1) place sewer and water in the Hwy. #10 right-of-way which will require obtaining a new permit, submitting new plans and surveys and obtaining temporary easements; 2) cut down on easement widths over the existing alignment to decrease right-of-way costs but forego MSA funds because the easement would not be adequate to accommodate a State aid street; 3) reduce temporary easements by 40 feet on the original plan to reduce costs slightly; 4) stop the project completely. Councilmember Pearson stated that he feels property owners may be more receptive to easement negotiations at this time because they are beginning to realize that the best situation is to align sewer and water in the frontage road right-of-way rather than have to pay for laterals being extended from Hwy. #10. A project in the future may also not include deferred payments. Mr. Hartley stated that staff is recommending that the City offer the City Council/October 27, 1987 Page 8 of 17
