Motion by Commissioner Ostrum that the cash settlement for park dedication for thirty-two units <br />equal $54,400 and that trail fee be satisfied by a cash payment of $12,800. <br /> <br />Commissioner Rolfe stated the cash dedication for trail ways is being brought up in item three. <br /> <br />Chairperson Cook stated that transportation down corridors is not eligible for trail dedication fee. <br />He stated there is no trail going in there at this time, only an easement is being given. He stated <br />Highway 47 is considered a traffic corridor. He stated this should be in the recommendation <br />from the Park and Recreation, or in the motion that the Commission is asking for a <br />corresponding easement to Highway 47 and that; it should be at not cost to the City. <br /> <br />Commissioner Johns asked if the motion should include the tot-lot. <br /> <br />Commissioner Ostrum stated he would withdraw his motion. <br /> <br />Motion by Commissioner Rolfe, seconded by Commissioner Johns, to recommend that the park <br />dedication for Sunwood Estates be fulfilled as follows: <br /> <br />1. That the development agreement specifies that the tot-lot be perpetually operated by ACCAP. <br />2. That the site plan identify a future trail route over the ACCAP property parallel to Trunk <br /> Highway #47 and that a corresponding easement be dedicated at no cost to the City. <br />3. That cash satisfy Park Dedication for the 32 units equating to $54,400. <br />4. That the trail fee be satisfied by a cash payment of $12,800. <br /> <br />Motion carried. Voting Yes: Chairperson Cook, Commissioners Rolfe, Johns, Olds, and <br />Ostrum. Voting No: None. Absent: Commissioner LaMere. <br /> <br />Case #3: Recommend Trail Paving Credit Policy <br /> <br />Parks/Utilities Supervisor Boos reviewed that for the past several years, trails within the limits of <br />new subdivisions have been constructed as Stage 1 improvements. Credit against Trail Fees has <br />been identified and awarded for the construction cost within the Development Agreement. The <br />exceptions to the credit assigned has been for those segments along State, County and City MSA <br />roads where the trail route was previously identified on the Park and Trail Map. These trails <br />where viewed as part of the City's transportational system as opposed to their recreational <br />element. <br /> <br />Parks/Utilities Supervisor Boos explained that a number of years ago, the City enacted a Trail <br />Fee separate from the cash Park Dedication fee. While the above practice has continued since <br />enaction of the Trail Fee - it seems prudent to review this policy to ensure it remains fair, and in <br />the best interest of the City. He explained that the purpose of this case is to recommend a formal <br />position on this topic to City Council. Council may then adopt the policy by resolution - thereby <br />eliminating debate on this subject when negotiating with developers.
