Mr. Boos asked if it was equitable for a developer who does not have a trail obligation or is it <br />equitable between two developers, one of which would have a thousand feet, as compared to the <br />developer across the road who only had a hundred foot obligation or a trail system was already <br />constructed for. <br /> <br />Chairperson Cook stated that both developers would pay the trail fee. He stated that the <br />developer who would have the trail system next to the property would receive benefit to the <br />property by the recreational and transportation value of the trail. He stated the City should ask <br />them to provide the trail. He stated that when you put property next to a park, the property is <br />worth more and the people who live on that property have an added benefit of living next to a <br />park so asking them to pay more for the property would be fair. <br /> <br />Commissioner Olds stated that with the ordinance requiring sidewalks, a trail along a <br />transportation route would benefit everyone in the development. He stated the developer has the <br />responsibility to put in the trail or sidewalk within the development. He stated any other <br />connectivity trails that are through nature areas that are not abutting streets would be part of the <br />trail fee. He stated the developer would put the trail through for credit. Anything that is <br />adjoining or abutting the standard modes of transportation streets or highway systems as part of a <br />sidewalk requirement should be there. <br /> <br />Mr. Boos stated that this would bring the trail to the City standard. <br /> <br />Commissioner Rolfe asked how the City handles the issue of construction of a road through the <br />development of their land. Does the developer have to pay for the construction of the road or <br />partial construction of the road or does the City construct the road through the development. <br /> <br />Mr. Boos stated the entire cost is born by the developer unless this is considered a Minnesota <br />State aid road. If it were, then the City would contribute some value of it being a State aid road <br />over and above the residential street construction costs. <br /> <br />Commissioner Johns stated this should be kept as is. <br /> <br />Mr. Boos stated it is important the Commission recommend a standard policy regarding this. He <br />stated the Council can view it differently, but at least the Commission would be taking a stand <br />that says they would want to continue doing this the way it has been done in the past. <br /> <br />Commissioner Johns asked if Mr. Boos would like to formalize this and then have the <br />Commission adopt it. <br /> <br />Mr. Boos stated that it would be an ordinance and could be incorporated into City code similar to <br />the open space recreational requirements. He recommended the Commission to recommend this <br />to the Council. <br /> <br />Chairperson Cook stated Troutbrook has many environment issues and that is what the trail fee <br />fund is for.
