Mr. Boos stated this issue is a good reminder to Staff and the Commission that they need to <br />continue working on the plan and make sure this is as current as can be without bringing it back <br />every meeting. <br /> <br />Commissioner Olds clarified that on the trail plan map as part of the process they will be going <br />through, the current version be updated and any trails that are not existing be a point of <br />clarification on the map as a proposed trail or park and someway identify this on the map as a <br />future project. <br /> <br />Mr. Boos stated there are color variation between the proposed and the planned development on <br />the map. He stated it is impossible to keep this in sync at all times. <br /> <br />Chairperson Cook agreed the Commission should keep current and this should be an ongoing <br />project. He stated that people are better off knowing there would be an easement when they buy <br />the land. <br /> <br />Mr. Boos stated he talked to a person on Sunwood Drive who was an opponent to the sidewalk. <br />He stated this person liked the trail now that it was finished and the landscaping was done. <br /> <br />Chairperson Cook stated people are motivated by fear when they do not know what is going to <br />happen but are usually pleased with the recreation aspect once the trail goes in. <br /> <br />Case #4: Receive Typical Development Agreement <br /> <br />Parks/Utilities Supervisor Boos reviewed that at the Commissions regular January meeting a <br />number of questions were brought up that are routinely addressed in the development agreement <br />process. Tree conservation was one of the issues sited. He reviewed the Development <br />Agreement for Highlands at River Park, noting that as of October of this year the developer will <br />of submitted three different playground plans. If this were not done, then they would face <br />consequences. <br /> <br />Chairperson Cook stated this covers tree conservation and Oak trees from damage. <br /> <br />Commissioner Olds asked who wrote the development agreement. <br /> <br />Mr. Boos stated the Community Development wrote this but it has to be approved by the <br />Planning Commission. <br /> <br />Commissioner Olds stated on page 41 letter G, "whole trees may not be disposed of by <br />burning...brush under six inches in diameter and stumps less than four feet of the main trunks <br />attached can be burned if a burning permit is applied for". He asked if this was something that <br />would generally be allowed. <br /> <br />Mr. Boos stated there are some limitations on that. He stated that wind direction, public <br />nuisance, a lot of things come into play.
