Mayor Gameci stated that if the property is zoned commercial and a plan for a commercial <br /> [ <br />development comes before the City Council and meets all of the criteria the COuncil is not able <br />to deny the request. <br /> <br />Councilmemb~r Strommen stated that this is one that she has struggled with because there is a lot <br />of commercialluse in the area, but there is also residential development. A lot of it for her comes <br />down to the riger because she would like to be able to control what is built along the river and <br />not allow for alheavy commercial use. <br /> <br />Councilmemb~r Cook replied that if the property is zoned residential they will have commercial <br />uses in front o~' the property and to the west of the property. If the property is not designated as <br />mixed use they are not lea~ing the ability for the property owners to work the different <br />commercial arid residential developments in the area. He suggested that the land fi.om Highway <br />#10 to the river should all be designated as missed use. If the property is zoned residential a <br />developer will not pursue it for a commercial development if it requires .rezoning and <br />comprehensiv~ plan amendment. <br /> <br />Councilmember Kurak stated that that is assuming that the market would be looking for a <br />cormnercial use on the property. <br /> <br />City Adminiatrator Norman explained that the City has changed the land use in the <br />ComprehenSiVe Plan to residential so the City is required to make the change unless the Council <br />wants to go,t~ough a comprehensive plan amendment process. <br /> <br />Mr. Holasek r~oted that the City just went through a comprehensive plan amendment process for <br />another proPei'ty that was designated mixed use so he did not think it was that difficult of a <br />process. : <br /> <br />City Attorn~'y ',Goodrich explained that a comprehensive plan amendment would require a public <br />hearing and th~ Met Council would have to approve the amendment. <br /> <br />Mr. Holasek ~tated that someone is not going to purchase the property if they have to build it <br />residential. With a mixed-use designation it allows for them to buffer between residential and <br />commercial. <br /> <br />Mayor Game~ replied that if a developer comes in with a plan for commercial development then <br />the City can vC. ork with them. <br /> <br />Mr. Holasek noted that if the property is zoned residential the developer could place a residential <br />development ~ght along the commercial area. <br /> <br />Mayor Game¢ stated that they will probably find out that they will get more money for the <br />residential development than commercial development. <br /> <br />Councilmemb~r Strommen agreed that it was a difficult situation, but. if they put the two. parcels <br />together, north and south of Riverdale Drive, there is a mixed use with the commercial area to <br /> <br />City Council/December 16, 2003 <br /> Page 21 of 32 <br /> <br />P91 <br /> <br /> <br />
