Case #2 <br /> <br />Request for a Variance from Street Frontage or Lot Width Requirements; <br />Case of Greg Bauer <br /> <br />Presentation <br /> <br />Assistant Community Development Director Trudgeon explained Greg Bauer is requesting a <br />variance to the minimum lot width or street frontage requirement as part of a minor subdivision <br />request. Mr. Bauer is proposing to re-plat two existing lots into two new lots. He stated one of <br />the lots has an existing residence located upon it. He indicated the total area to be subdivided is <br />14.17 acres and Mr. Bauer would like to create a 2.5-acre parcel and an 11.67-acre parcel. The <br />subject property has frontage on 161st Lane and 160th Lane. <br /> <br />Assistant Community Development Director Trudgeon advised for residential areas outside of <br />the MUSA, City Code does not permit lots to be created that have less than 200 feet of lot width <br />at the street right-of-way. He stated as demonstrated on the sketch plan, the property under <br />consideration has frontage on two streets. Lot 1, with the existing homestead, meets the 200-foot <br />lot width requirement at 161st Lane NW. Lot 2 has 105 feet of lot width/street frontage along <br />161 st Lane and 66 feet of lot width/street frontage along 160th Lane NW. He further advised the <br />frontage for the proposed Lot 2 is fragmented. The frontage along 161st Lane NW leads into a <br />current horse pasture. The future residence on Lot 2 is proposed to receive access from 160th <br />Lane NW. He advised the right-of-way for 160th Lane dead-ends into the proposed Lot 2 and is <br />currently not constructed all the way to Mr. Bauer's property line. He stated the paved road stops <br />360 feet short of Mr. Bauer's lot line, and as part of the subdivision, Mr. Bauer is requesting that <br />he not be required to construct the extension of the road to his property line, but instead be able <br />to put a bituminous driveway within the public right-of-way. <br /> <br />Assistant Community Development Director Trudgeon summarized that there is a fragmented <br />total of 171 feet of street frontage for Lot 2, and the primary access to Lot 2 will be from 160th <br />Lane NW, which has 66 feet of unimproved public right-of-way that dead ends into the property. <br />He stated in order to subdivide as proposed, Mr. Bauer needs to receive a variance to the lot <br />width at street frontage. He noted that the lot Mr. Bauer would like to place the new residence is <br />a current lot of record and its only access if from the 160th Lane NW right-of-way. <br /> <br />Assistant Community Development Director Trudgeon stated the City Council had a work <br />session on this:subject, with the minutes attached to Staff's report, at which two issues were <br />raised; lot size~ which has been increased, and the private drive. The City Council stated they <br />might be willing to allow this subdivision as long as the 66-foot easement was provided to <br />extend 161 st Lane NW to the west. <br /> <br />Public Hearing <br /> <br />Richard Taylor, 7167 159th Lane stated he has lived there for 31 years.
