Case #5: Request for a Conditional Use Permit for an Oversized Accessory Building; <br />Case of David and Gail Hennek <br />Community Development Director Frolik stated that the City received an application from <br />Singeo Builders, representing David and Gail Hennek, for a conditional use permit to exceed the <br />accessory building size restrictions established in City Code on the property located at 16100 <br />Wolfram St NW. The proposed building will be 1,408 square feet (32' x 44') in size. Coupled <br />with the existing garage (704 sq. ft.), the applicant would have 2,112 sq. ft. in accessory building <br />space. This results in an overage of 448 square feet. The applicant would like to exceed the size <br />restriction in order to construct a detached accessory building that would accommodate the <br />storage of private use vehicles and equipment. The Planning Commission conducted a public <br />hearing on October 2, 2003, and there were no verbal or written comments submitted regarding <br />this request. The Planning Commission recommended the City Council approve the conditional <br />use permit request. <br />COUneilmenlber Kurak inquired if the legal easement is recorded. <br />David Hennek, 16100 Wolfram Street NW, Ramsey, replied that the easement was recorded in <br />the County of Anoka. <br />Motion by Councilmember Cook seconded by Councilmember Pearson, to adopt Resolution #03- <br />10 -277 adopting Findings of Fact # 0654 relating to David and Gail Hennek's request for a <br />conditional use permit for an oversized accessory building on the property at 16100 Wolfram <br />Street NW. <br />Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Cook, Pearson, Elvig, Kurak, <br />Strommen, and Zimmennan. Voting No: None. <br />Motion by Councilmember Elvig, seconded by Councilmember Kurak, to approve David and <br />Gail Hennek's request for an oversized accessory building based on the Findings of Fact # 0654 <br />and adopt Resolution #03 -10 -278 declaring terms of same. <br />Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Elvig, Kurak, Cook, Pearson, <br />Strommen., and Zimmerman. Voting No: None. <br />Case #6: Adopt Ordinance and Resolution Authorizing the Transfer of the Westerly <br />20 feet of Outlot B Apple Ridge Subdivision to Adjacent Property Owners <br />Assistant Director of Public Works Olson stated that in May 2003, the City obtained Outlots B <br />and C of the Apple Ridge Subdivision form US Homes at no cost. The purpose of the property <br />transfer of these outlots, which were already encumbered with drainage and utility easements, <br />was to allow the City to construct a trail adjacent to T.H. #47. The residents adjacent to Outlet B <br />expressed concerns about the trail adversely affecting their privacy since the outlot contains a <br />City Council /October 14, 2003 <br />Page 15 of 30 <br />
