berm, which is substantially higher than their properties and could allow trail users to look down <br />into their backyards. The City Council approved the transfer of the westerly 20 feet of this 45 <br />foot outlot to the adjacent property owners. This would allow the property owners to control the <br />highest portion of the outlot. It is their stated intension to construct a privacy fence atop the berm <br />to ensure their ,privacy. The trail has now been constructed within the easterly 25 feet of the <br />outlot. The ordinance was introduced at the September 23, 2003 Council meeting. <br />Motion by Councilmember Pearson, seconded by Councilmember Cook, to adopt Ordinance <br />#03 -41 authorizing the transfer of certain City owned property located in the City of Ramsey. <br />Further discussion: Councilmember Zimmerman inquired if the City was retaining a drainage <br />and utility easement over the 20 feet the City is transferring title to. Assistant Director of Public <br />Works Olson replied no. Councilmember Zimmerman inquired if staff was sure that there were <br />no utilities under the 20 feet. Assistant Director of Public Works Olson stated that if the Council <br />wanted to reserve a drainage and utility easement over the 20 feet they could amend the <br />ordinance. <br />Motion was amended to include language in the ordinance stating that the City will be reserving <br />a drainage and utility easement over the 20 -foot parcel. <br />A roll call vote was performed by the Recording Secretary: <br />Councilmember Pearson aye <br />Councilmember Elvig aye <br />Councilmember Strommen aye <br />Councilmember Kurak aye <br />Councilmember Cook aye <br />Councilmember Zimmerman aye <br />Mayor Gamec aye <br />Motion carried. <br />Motion by Councilmember Pearson, seconded by Councilmember Cook, to adopt Resolution <br />#03- 10 -178A authorizing the transfer of the westerly 20 feet of outlot B Apple Ridge addition <br />with the addition of the language that the City will be reserving a drainage and utility easement <br />over the 20 foot parcel. <br />Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Pearson, Cook, Elvig, Kurak, <br />Strommen, and Zimmerman.
