Golder Associates Inc., the City of Ramsey has been asked to execute the resolution presented by <br />staff. This resolution authorizes the application to the Minnesota Department of Trade and <br />Econoric Contamination Cleanup Grant Program. The grant application, as requested, will be <br />used to finance up to $50,000 to be used to finance more environmental study to determine the <br />mitigation elements that are necessary to clean up the site from lead contamination. <br />COUneilmember Strommen stated that she thought it was great that the property owner was <br />researching grant opportunities. She inquired as to what it meant for the City to act as the legal <br />sponsor. <br />Assistant Director of Public Works Olson explained that the application was supplied by the <br />Department of Trade and Economic Development and any cost associated with the application <br />and study would be the developer's responsibility. He stated that he thought the City would want <br />to be the legal sponsor to show support for the study and to make sure the information is <br />accurate. <br />City Attorney ,Goodrich recommended that an additional `Therefore' be added stating by <br />adopting the resolution the City does not accept any legal liability for any lead contamination that <br />may exist on the property. <br />Councilmember Elvig inquired if by adding the language to the resolution they are eliminating <br />any legal ramifications for the City if lead is found on the property. <br />City Attorney Goodrich replied in the affirmative. <br />Councilmember Elvig inquired if the City was going to be overseeing the process. <br />Assistant Director of Public Works Olson replied that staff would want to retain a consultant to <br />review the information provided from the study. <br />Councilmember Elvig inquired if the landowner would be subjected to paying those fees for the <br />cost of the review. <br />Assistant Director of Public Works Olson replied that he believed that those are costs that will be <br />covered by the feasibility study that will be occurring for the same area, but that was something <br />staff could re- iterate. <br />Councilmember Kurak stated that she thought the grant was a great idea, but she did not think <br />that the City should have to pay any fees. <br />Motion by Councilmember Kurak, seconded by Councilmember Pearson, to adopt Resolution <br />#03 -10 -279 authorizing application to the Minnesota Department of Trade and Economic <br />Development contamination cleanup grant program for various projects as amended by the City <br />Attorney and that any expenses incurred by the City as a result of the study will be paid for by the <br />landowner or developer. <br />City Council /October 14, 2003 <br />Page 17 of 30 <br />
