that he interprets the ordinance to require a 20 foot minimum side yard
setback on both side yards when a property is located on a corner; he is
recommending that Holiday apply for a variance to the east side yard
setback.

Mr. Hoeschen of Holiday Stationstores was present and stated that Holiday
and the Ramsey Planning and Zoning Commission agree that the ordinance
require~ a 20 foot side yard setback on the external side and the regular
10 foot side yard on the internal side yard.

Mr. Hoesehen referred to the requirement for a 60 foot easement for future
service road and stated that Holiday is not agreeable to purchasing land
and donating part of it for a service road that might be developed and if
it is, Holiday would then be assessed for the improvement and that
assessment would include acquisition costs. If in the future the City does
construct the service road and if the right-of-way necessary is donated,
Holiday may consider the request in a different light; in the meantime,
Holiday has no intention of expanding it's development onto that rear
portion of the property planned for a service road and the City maintains
control of that through the site plan process.

The City's offer to enter into an agreement to convert the property back to
the property owner if the service road is not constructed was also not
agreeable to Mr. Hoeschen.

Motion by Councilmember Sorteberg and seconded by Councilmember Bawden to
adopt Findings of Fact 0230 relating to Holiday Stationstores request for
site plan approval, amended as follows:

Add Item #15 to reflect that the developer has indicated an
unwillingness to donate a 60 foot easement for frontage road/drainage/
utility purposes.

Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg,
DeLuca, Pearson and Bawden. Voting No: None.

Motion by Councilmember Bawden and seconded by Councilmember DeLuca to
approve the site plan for Holiday Stationstores, Inc.

Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg,
DeLuca, Pearson and Bawden. Voting No: None.

With regards to the easement for frontage road/utilities, Mr. Goodrich
suggested that another option would be to include encumbering language in
the development agreement which would allow the City to purchase the
easement im the future at 1988 prices or less.

Motion by Councilmember Sorteberg and seconded by Councilmember Pearson to
authorize the Mayor and the City Administrator to enter into a development
agreement with Holiday Stationstores, Inc., with said agreement amended as
follows:

City Council/October 25, 1988
