§ 9.50.30 Subdivi~on - Design S~-~ncl~:ts <br /> <br /> Subd, 11. Agreement as to dedication. Agreements as to the <br />requirements in §9.50.37 Subd. I through 9 above shall be made prior to <br />preliminary plat approval. Failure of the City Council and subdivider to reach <br />agreement regarding the matters in §9.50.37 Subd. 1 through 9 above shall <br />constitute denial of the preliminary plat. <br /> <br /> Sub& 12. Exceptions. In the case of a request to divide a lot which is a <br />part of a recorded plat where the division is to permit the adding of a parcel of land <br />to an abutting lot which does not create a new buildable lot, the subdivider shall be <br />exempt from complying with any procedural requirements of this ordinance. <br /> <br /> Sub(L 13~ Application to minor subdivisions. In the event of a minor <br />subdivision, the provisions of this Chapter shall apply to the new lots being created <br />rather than the gross area being subdivided. <br /> <br />Subd. 14. Application to resubdivlsion. <br /> <br />In the event of a resubdivision of a parcel for which park <br />dedication requirements have previously been met, no additional <br />park dedication requirements shall be imposed as a result of the <br />resubdivision providing the overall density of development of the <br />parcel remains the same as the density allowed under the zoning <br />in effect at the time of the initial subdivision. <br /> <br />In the event that park dedication requirements were met through <br />the use of a fee per dwelling unit or based on the value of the <br />improvement, additional park dedication shall be made for each <br />new lot created under resubdivision. <br /> <br />The park dedication fee shall be based on the specified <br />contribution per dwelling unit for residential properties resulting <br />from the resubdivision. <br /> <br />9.50.38 Fh plain requirements.
