For the past couple of years at least, one of the occupants at 7127/7129 Hwy. #10 <br />N.W. has been Doug Berens of East Lake Auto. The other occupant is Dalles RV. I have reason <br />to believe that East Lake Auto bears most of the responsibility for the condition of premises at the <br />subject property. However, I am not ruling out the possibility that Dalles RV may also have <br />contributed to the situation that currently exists. <br /> <br />As you know, since 1989 there have been problems on the subject property with regards to <br />condition of premises. The property is zoned B-3 Highway Business, for which auto repair is a <br />permitted use. However, City Code specifically defines and prohibits junk yards, vehicle <br />wrecking yards and auto salvage activity. In June of this year, Doug Berens of East Lake Auto <br />was called before the Planning and Zoning Commission to discuss a schedule for removing ali <br />evidence of auto salvage activity on the subject property. Mr. Berens indicated at that time that he <br />would be vacating the property in September, but in the meantime, he promised to make progress <br />towards cleaning up the site. In September, I scheduled East Lake Auto on the Planning and <br />Zoning Commission agenda for review of clean up efforts. At that time, I presented the <br />Commission with photographs of the property that reflect that the situation had worsened. In <br />addition, I u-/ed to contact Doug Berens by telephone and the operator informed me that the <br />telephone has been disconnected. That leads me to believe that East Lake Auto left the property as <br />planned in September, but failed to take their debris with them. <br /> <br />The Planning and Zoning Commission is very concerned about the situation and in accordance <br />with City Code, directed me to issue a letter to the property owner requiring that the blight be <br />abated within 10 days. If there is no action on the pan of the property, owner to respond to that <br />order, the matter is brought before City Council as a code violation for review and <br />recommendation. The Council can then order the abatement of the blight at the City's expense and <br />recover the expenditure, plus an additional 25%, by civil action or by certifying a special tax <br />against the property with the County Auditor's office. <br /> <br /> <br />
