Case #4: <br /> <br />Adopt Ordinance to Rezone Certain Property from R-2 Medium Density <br />Residential to B-2 Business; Case of Scott Hagen <br /> <br />Mayor Gamec explained this ordinance is a correction, as this property was inadvertently shown <br />as Residential in the 2001 Comprehensive Plan and subsequently zoned R-2 Residential. The <br />Council conducted its first reading of the request for zoning amendment at the February 10, 2004 <br />meeting. <br /> <br />Motion by Councihnember Elvig, seconded by Councilmember Kurak, to adopt Ordinance #04- <br />03 to rezone the subject property from R-2 Medium Density Residential to B-2 Business, based <br />on the Findings of Fact, and contingent upon City Council and Metropolitan Council approval of <br />the Comprehensive Plan Amendment. <br /> <br />A roll call vote was performed by the Recording Secretary: <br /> <br />Councihnember Cook aye <br />Councilmember Elvig aye <br />Councilmember Kurak aye <br />Councilmember Pearson aye <br />Councilmember Strommen aye <br />Com~cilme~nber Zimmerman aye <br />Mayor Gamec aye <br /> <br />Motion carried. <br /> <br />Case #5: Request for a Home Occupation Permit; Case of Jim Kreuser <br /> <br />Assistant Community Development Director Trudgeon stated that Mr. Kreuser resides at 17731 <br />Eaton Street and has been operating a custom cabinet business within an accessory structure <br />located on his property for the past 17 years. The business is considered illegal non-conforming <br />and therefore Mr. Kreuser submitted a home occupation permit application to bring his business, <br />Kreuser Cabinets, into compliance. <br /> <br />Assistant Community Development Director Trudgeon explained the newly adopted Home <br />Occupation Ordinance states that a person can apply for a permit from the City to operate a <br />business within an accessory structure if the property is at least three acres in size, said business <br />is Iow intensity, and does not adversely affect the character of the residential neighborhood. Mr. <br />Kreuser's parcel is 3.1 acres in size and according to his letter dated January 12, 2004, his <br />business operation appears to meet the intent of the Home Occupation Ordinance. Assistant <br />Community Development Director Trudgeon explained City Code states that for a parcel three <br />acres in size one non-resident employee is permitted. Mr. Kreuser employs his son-in-law who is <br />a non-resident. The proposed business cannot generate excessive vehicular traffic trips within <br />the residential neighborhood. Mr. Kreuser's property is three acres in size and is surrounded by <br />parcels that are similar in size. It is staff's opinion that the proposed business operation and the <br />size of the subject property and surrounding properties results in Kreuser Cabinet's being <br /> <br />City Council/February 24, 2004 <br /> Page 8 of 31 <br /> <br /> <br />
