Voting No: <br />Chairman Zi~merman and Commissioner Terry. Absent: Commissioners Hendriksen and <br />Thorud. , <br /> <br />Motion by COmmissioner Deemer and seconded by Commissioner Terry to delete Item//28 of the <br />proposed Findings of Fact, as it was a repeat of Item #27. <br /> <br />Motion carriad. Voting Yes: Chairman Zimmerman, Commissioners LaDue, Bawden, Deemer <br />and Terry. Vbting No: None. Absent: Commissioners Hendriksen and Thorud. <br /> <br />Motion by COmmissioner Deemer and seconded by Commissioner Bawden to amend Item #29 of <br />the proposed[Findings of Fact to indicate that the proposed use will not be harmonious with the <br />comprehensive plan. <br /> <br />Further DisCt~ssion. Chairman Zimmerman questioned how the City could grant a conditional use <br />permit for ~ iparticular use and then not allow an expansion of the same use. Commissioner <br />Deemer stated, that facts have chan~ed since the original CUP was issued and the use as it exists <br />now is not 'ill conformance with tl~e comprehensive plan. Commissioner Terry noted that the <br />conditionaLu}e permit is referring to the use and not to the operation. Mr. Otto noted that in the <br />original conOtion~al use permit, the findings indicated that the proposed use will be harmonious <br />with the com}reh~nsive plan. Commissioner Deemer noted that when the original conditional use <br />permit was ~nsi~ered, the City was not informed that Mr. Karst would be disassembling and <br />storing buse~/ion ~tdjacent property. Mr. Otto noted that the proposed amended conditional use <br />permit also d}es not include storage of buses; the storage of feed stock on adjacent property would <br />be addressed~undCr a new condit~nal use permit and site plan. In the meantime, Lots 4/2 and #3 <br />were not incl~dect in the original conditional use permit, therefore, Mr. Karst is in violation of the <br />ordinance re~ardipg screening for uses that occur in an industrial zone. Mr. Karst stated that as he <br />understands the situation, he has three options for Lots #2, 4/3 and #4: 1) apply to the City for a <br />conditional ~se permit and site plan approval; 2) screen the buses; or 3) remove the buses. <br />Commission,s D~eemer and Bawden withdrew their motion. <br /> <br />Motion by commissioner LaDue and seconded by Commissioner Ten3., to amend Item #29 of the <br />proposed F~i~d~ngs of Fact to indicate that the proposed use will be harmonious with the <br />comprehenSi'~e plan. <br /> <br />Ix/lotion carried.
