City Council Adopt the Findings of !Vact as amended relating to Mr. Daniel Karst's request for a conditional us~: pe/mit to expand an a}uminum recovery and p~'ocessing business. Motion carried. 'Voting Yes: Chairman Zimmerman, Commissioners LaDue, Bawden, Deemer and Terry. V0tingNo: None. Absent: Commissioners Hendriksen and Thorud. Mr. Karst stated l:hat all he is really requesting is to be able to install a second furnace in his operation, to t/eep iinventory at a minimun~ and modify the furnaces to operate with afterburners to solve odor and em, ission problems. Mr. Karst added that recycling is important to the society and to not try evc~ m~ans to keep things out of landfills is a step backward. Sharon Wa~s0~n stated that her client is attempting to work with the City to solve issues and in doing so, he. ilhasrmvested $100,000.00 to date on Lot #1 and proposing to invest another $25,000.00 f~r the installation of afterburners. Ms. Watson asked that the City not deny Mr. Karst's appliq,~.tion for an amended conditional use permit as the intent of the amendment is to address some [of the problems that have been raised under the existing conditional use permit. Commissioner Deemer stated that if the request were to be denied, it would basically be denying the start up o~ a s~cond furnace and not an improvement to the existing furnace by the addition of an afterburnet~. COmmissioner Deemer also stated that in his opinion, the existing furnace should be improved .',~ith ~the addition of an afterburner to prove that it will control smoke and odor before the City consid' 'erslexpanding the operation to two furnaces. .I Motion by (2om~nissioner LaDue and seconded by Commissioner Terry that, based on the Findings of. ~act,! the Planning and Zoning Commission concludes that the proposed use does comply with [he requirements of the City Code, Sections 170.013D and accordingly recommends approval of t~e application for a conditional use permit by Danny's Aluminum Processing, Inc. Motion carrie,,d. Voting Yes: Chairman Zimmerman, Commissioners LaDue and Terry. Voting No: Commis,'Sionbrs Deemer and Bawden. Absent: Commissioners Hendriksen and Thom& Commissiongr LaDue stated that operation of an aluminum processing facility is a learning experience 'f~r both the City and the applicant and also that the City approved the use when it approved the~riginal conditional use permit. The City owes it to him and the public to make every attempt to rn~e it, work. Chairman Zimmerman stated that it would not be appropriate to approve a conditional use permit, let the owner,iinvest $100,000.00 in improving the site and then shut him down. Commissioner LaDue noted that the City also has to depend on City staff to control complaints and violations. .: Motion by Chairman Zimmerman and seconded by Commissioner LaDue to indicate that an), time there is an :iricidc~nt report filed regarding Danny's Aluminum Processing, the applicant will be nonfied ~mmedmtely, regardless of the time of da),, in order that he ma), take immediate action to correct the Problem.
