Mr. Otto noted that some of the cNteria for monitored testing have been eliminated. Thc time frame <br />for testing remains annually. <br /> <br />The applicant is requesting that the time frame for testing coincide with MPCA guidelines, which is <br />every five years for this type of facility. <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Terry to amend Item #9 of the <br />proposed Conditional Use Permit to delete reference to "other feed stock" and add a sentence to <br />indicate that disassembly of other feed stock shall be permitted in an enclosed or screened area. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners LaDue, Bawden, Deemer <br />and Terry. Voting No: None. Absent: Commissioners Hendriksen and Thorud. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner LaDue to amend Item #13 of <br />the proposed conditional use permit to indicate that the applicant must submit a site plan and <br />conditional use permit application to the City three (3) weeks prior to the April, 1991 regular <br />Planning and Zoning Commission meeting. This site plan and conditional use permit shall address <br />Lots #2 and #3. In addition, Item #5 under Term 13 was deleted and replaced with language <br />indicating that the storage of feed stock currently existing on Lots #2 and #3 may continue as long <br />as the number of buses reduces and no additional buses are brought on to the site. <br /> <br />Further Discussion. A discussion ensued regarding the proposed conditional use permit requiring <br />Mr. Karst to submit an application for a site plan and conditional use permit to address Lots #2 and <br />#3, but there is no provision that would require Mr. Karst to follow through with the development <br />if it is approved. <br /> <br />Ms. Frolik noted that all site plans include a negotiated completion date for improvements. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners LaDue, Bawden, Deemer <br />and Terry. Voting No: None. Absent: Commissioners Hendriksen and Thorud. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Terry to amend Term #30 of the <br />proposed conditional use permit so that the last sentence will read as follows: <br /> <br />"An increase in furnace capacity or a third melt furnace shall not be added to <br />the operation without application and approval of a new conditional use permit." <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners LaDue, Bawden, Deemer <br />and Terry. Voting No: None. Absent: Commissioners Hendriksen and Thorud. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner TenD, to direct City staff to <br />modify any other proposed conditional use permit terms that refer to amended conditional use <br />permits. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners LaDue, Bawden, Deemer <br />and Terry. Voting No: None.
