Motion ~YiCo%~cilmember Van Wagner and seconded by Councilmember Sorteberg to adopt ReSOlution ~84-34 to approve the preliminary Planned Unit Development of FlintW~Od ~ills Plat Second Addition as presented in Exhibit "B" and to refer~ back to the Planning and Zoning Commission with the additional condition~ tO!be considered (Councilmember Schlueter's concerns regarding open space, r~strictive covenance and homeowner's association with respect to junk cars ~nd pets, etc., Councilmember Schlueter's concerns regarding Item #5 £~ th~ findings of fact). (Please refer to resolution file for Resoluti°n #8~-34) . Further D~scuss~on: City Attorney Goodrich stated that the PUD plat will now gO ~a~k ~ Planning and Zoning to review concerns brought out in tonight's meeting, ~If~Planning and Zoning determines the PUD plat to be in substantial compliances, t~e developer will offer the plat back to Council for their final apP~ova~. After Council final approval, Council will address the subject of zoning i~o ~ PUD zone. Councilmember Schlueter inquired if sewer and water will be ~que~ted after the above are accomplished? City Attorney Goodrich replied that'kt would be. Mr. Goodrich also noted that findings of fact will be a~opt~d when the plat is brought to Council for final approval. Motion c~rrie~.
