The subdivider shall submit a topographical, site, grading and <br /> landscape plan prepared by a registered engineer or landscape architect <br /> to the City for approval dunng the preliminary plat process. <br /> <br /> iSubd. 10. Agreement as to dedication. Agreements as to the <br />requirements in §9.50.37 shall be made as part of a performance contract presented for <br />approval along with the final plat. Failure of the City Council and subdivider to reach. <br />agreemem regarding the maners in §9.50.37 above shall constitute denial of the plat. <br /> [Subd. 11. Exceptions. In the case of a request to divide a lot <br />which is a pan of a recorded plat where the division is to permit the adding of a parcel of <br />land to an:abu.tting lot which does not create a new buildable lot, the subdivider shall be <br />exempt frdm complying with an), procedural requirements of this ordinance. <br /> iSubd. 12. Application to minor subdivisions. In the event of <br />a minor st!bdiv.:ision, the provisions of this Chapter shall apply to the new lots being created <br />rather than the !gross area being subdivided. <br /> !Subd. 13. Application to resubdivision. <br /> i :a. In the event of a resubdivision of a parcel for which park dedication <br /> ~ requirements have previously been met, no additional park dedication <br /> requirements shall be imposed as a result of the resubdivision <br /> providing the overall density of development of the parcel remains the <br /> same as the density allowed under the zoning in effect at the time of <br /> the initial subdivision. <br /> <br /> b. In the event that park dedication requirements were met through the <br /> use of a fee per dwelling unit or based on the value of the <br /> improvement, additional park dedication shall be made for each new <br /> lot created under resubdivision. <br /> <br /> The park dedication fee shall be based on the specified contribution <br /> per dwelling unit for residential properties resulting from the <br /> resubdivision. <br /> <br />9.50.50 ~Construction of Improvements <br /> <br />Section .9.50.50 is hereby repealed and amended to read as follows: <br /> <br /> · ~Subdivision 1. General conditions. Upon receipt of prelimina_rv <br />approval of a: Plat b', the CiD Counci, and prior to Council approx al of the final plat. th~ <br />subd~vide.r shell make provision in the manner hereinafter set forth for the installation, at <br />the sole ~eXpenSe of the subdivider, of such improvements as shall be required bv the City. <br />which im~rov{rments may include, but are not limited to, streets, sidewalks, public water <br />systems, sanitc, ry sewer systems, surface and storm drainage· svstems and public utiliw <br />services.
