Councilmen~ber { adoption: introduced the following resolution RESOLUTION #92-02- and moved Wi'I~RgAS, F'& R Enterprises, a,,.Minnes,o, ta Partnership, has applied to the City for a Minn'e~ta ,Pollution Control Agency ( MPCA ) open burning permit; and Wit~RI~AS, the open burning permit request is for permission to conduct described legally as opening ba~ing ~n that property follows: The Northeast Quarter of the Northwest Quarter of Section 29, TOwnship 32, except the right-of-way line of the Burlington ' N}orthern Railway, County of Anoka, State of Minnesota; ~ (t~e "Site"); and Wit]gR~AS, the purpose of the burning is to bum a substantial number of fallen pine trees On :the }ite which are damaged and dead; and WHI~R~AS, the damage to the trees occurred as a result of a fire in April 1988, allegedly cat{sed bY a passing train; and ' f ~ WI~RE~S, the City previously denied an open burning permit to F & R in July 1989 baseid5~n th}n extremely dry conditions at the site including possible smoke nuisance and fire'ha~d totadjacent properties; and · wI 8 tms, F & R proposes to burn only during periods when the adjacent grouna cov_eitis rrtoisture saturated; and WI-II~RE~_S, the City's Fire Chief is of the opinion that the snow cover provision will substan~ally ~ecrease the fire hazard from the burning site and surrounding properties; and ,~ WI!~RIg~s, the City has the authority to issue open burning permits conditioned upon compli~ce.: With, MPCA rules and regulations; and WH~RE~S, the City requires that the open burning be in compliance with MPCA rules and rog~rlati~ns relating to air quality and air emissions. NOW Ta t iOa , IT } SOLVE TI E CITY COUNCIU OF CITY O'1~r,~RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: [ That the City C~uncfl hereby grants an open burning permit to F & R Enterprises, a Minneso~ P~n¢~ship, upon the following conditions: 1) T, hOl~nin~ (9) conditions as contained on MPCA "Application for Permit for Open Burning , ~t~C~py' ~.f which application is attached hereto and incorporated herein. 2) The b!~rm~g permit is issued for that property legally described as follows: · Th& Northeast Quarter of the Northwest Quarter of Section 29, T0~vnship 32, except the right-of-way line of the Burlington ' NO,bern Railway, County of Anoka, State of Minnesota. 3) The bllrni.~g will be conducted by and under the exclusive supervision and control of Sauter and ;Son~, Inc., 14050 Azurite Street N.W., Ramsey, Minnesota. 4) All b ~L~'ni,n~_ will be done in accordance with the rules of the MPCA and the City Code of the ~Cjty o~ Ramsey.
