Motion by Commissioner Terry and seconded by Commissioner Hendriksen to amend #16 to read <br />"That the proposed use will be maintained in order to be harmonious in appearance with the <br />existing and intended character of the R-1 Rural Residential District". <br /> <br />Motion carded. Voting Yes: Chairperson Bawden, Commissioners Terry, Hendriksen, Deemer, <br />Holland and LaDue. Voting No: None. Absent: Commissioner Thorud. <br /> <br />Motion by Commissioner Holland and seconded by Commissioner Hendriksen to amend #17 to <br />read "That the proposed use will be adequately served by essential public services". <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Holland, Hendriksen, <br />Deemer, LaDue and Terry. Voting No: None. Absent: Commissioner Thorud. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Terry to amend #18 to read <br />"That the proposed use will not create excessive additional requirements at public cost for public <br />facilities and services". <br /> <br />Motion carded. Voting Yes: Chairperson Bawden, Commissioners Deemer, Terry, Hendriksen, <br />Holland and LaDue. Voting No: None. Absent: Commissioner Thorud. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Holland to recommend that City <br />Council adopt the resolution adopting the findings of fact, as amended, relating to Brian Sohns <br />request to construct an accessory structure at 17958 Fluorine Street N.W. larger than allowed by <br />City Code. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Holland, <br />Hendriksen, LaDue and Terry. Voting No: None. Absent: Commissioner Thorud. <br /> <br />The Commission reviewed and discussed the terms of the conditional use permit. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Terry to amend #3 to read "That <br />the accessory structure shall be compatible in appearance with the principal structure on the <br />property and comply with the performance standards of City Code Paragraph 9.11.02, <br />Subdivision 12, subdivision a. <br /> <br />Further discussion: Commissioner Hendriksen stated that Commissioner Deemer's intent with the <br />amendment is to have the Building Inspector be the judge of whether or not the accessory structure <br />is compatible with the principal structure. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioner Deemer, Terry, Hendriksen, <br />Holland and LaDue. Voting No: None. Absent: Commissioner Thorud. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Holland to recommend that City <br />Council approve the request to construct an accessory structure at 17958 Fluorine Street N.W. <br />larger than allowed by City Code and accordingly, adopt the resolution declaring terms, as <br />amended, of conditional use permit. <br /> <br />Further Discussion: Commissioner Deemer stated he feels very confident with this proposal seeing <br />the expense the applicants are willing to go to in order to comply with City Code. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Holland, <br />Hendriksen, LaDue and Terry. Voting No: None.
