CASE <br />DISTRICT <br /> <br />#3: <br /> <br /> PRO[:ioSED REVISIONS TO B-3 HIGHWAY BUSINESS By: Zoning Administrator Sylvia Frolik <br /> <br />Backgroundl <br /> <br />As you recall, ~t y,o~ur regular meeting on October 6 we discussed some needed revisions to the B-3 <br />Hi~:hwa~/Busi~eS~,.District regulations. Per your direction, I have enclosed a draft revision of the <br />B-~ Dis~ct. 'f~he!lariditions to the district regulations are reflected in bold type and the deletions are <br />reflected with ~trik~outs. <br />ObservationS: <br /> <br />Subdivision 21 <br />'offices, bank~ <br />ordinance reqt <br /> <br />P~nnitted Uses) proposes to includ, e 'enclos,~,d retail sales and rental activity' and <br />'p~isonal and professional services. Items~ through 'n' are uses that our current <br />res h conditional use permit for provided they met certain performance standards. I <br /> <br />have proposed .to if~clude these uses as permitted uses in this district and the standards for granting <br />a conditional lise~ip~ermit were incorporated into Subdivision 4 (Standards). If we have already <br />determined that u~ler certain development criteria these uses should be allowed with a conditional <br />use permit, th/en~why not list them as permitted uses and incorporate the criteria into the <br />performance siandards. <br /> <br />Subdivision 3 ~A¢,eessory Uses) has been amended to allow outside storage (on a limited basis), <br />and outdoor s~,les,i [service, display and rental, as an accessory use of property versus requiring a <br />conditional usg p6rlnit. If we say motor vehicle sales, recreational equipment and implement sales <br />are permitted t~ses¢ lthen I believe it is more reasonable to establish performance standards for these <br />outside displa~ ~as than to require a conditional use permit for an activity so inherent to the <br />permitted use! Ih~addition, the ability to use property principally for exterior storage with a <br />conditional us:g.~ .~ rrmt" i ....... has been ehm~nated. In my op~mon, using a parcel solely for exterior <br />storage purposes !s~not appropriate along the highway corridor. <br /> ~ . <br /> <br />Subdivision 4 {Standards) has been amended to include all of those items that are currently listed as <br />criteria for va~ot/~ uses with a conditional use permit. A standard was also added to basically <br />require that an~ un¢sed portion of a site is landscaped and maintained. <br /> <br />Subdivision 5 {Setbacks) was amended with some minor deletions. <br /> <br />Recommendation: <br /> <br />Direct Staff to ~ak9 any additional amendments deemed appropriate and schedule a public hearing <br />of the prOpos{d r~visions to the B-3 District at the next meeting of the Planning and Zoning <br />Commission.
