Members <br />present: Donald Jacobson, Sue Van Wagner, John Beissel, Jerry Dulgar, <br />Patricia Lindquist and Alternate Ben Deemer. Absent: Donald Melrose and <br />Dean Rick. Staff present: Thomas Creighton. Representing Group W: <br />Terrence O'Connell, Roger Franke, Dick Beens and Terry Schuster. Guests: <br />Gary Ryman, Lloyd Snell. <br /> <br />Terry O'Connell presented Group W's Progress Report. Mr. O'Connell also <br />explained his letter to the Commission of September 22. Donald Jacobson <br />questioned the internal Group W memo dated August 9 concerning completion <br />of the L.O./Access equipment and the headend facility. The memo stated the <br />completion date as September 9. Mr. O'Connell explained that they thought the <br />electrical work and pulling of the cable could be completed at the same <br />time. However, they had to wait until the walls were painted and finished. <br /> <br />Chair Rartman questioned why the headend facility wasn't done. Terry O'Connell <br />said it was delayed due to Group W's error. They did not have enough money <br />to do the remodeling that was necessary. <br /> <br />Donald Jacobson asked out of 15 people hired how many were customer service <br />people. Mr. O'Connell said that there were two. Mr. Jacobson asked if <br />Group W was waiting for direction from the subcommittee concerning training <br />classes for the mobile van. Mr. Jacobson said that the subcommittee will <br />meet as soon as they can get together. <br /> <br />Jerry Dulgar questioned the $30,000 access grant for fostering local programming. <br />He wondered if this was a one time charge or an annual charge. Roger Franke <br />said that the bid should be looked at to determine this. <br /> <br />Concerning the availability of Tier 3 Mr. O'Connell stated that Group W has a <br />contract signed with a security system, <br /> <br />Thomas C~eighton presented his report. Me pointed out Group W's Capital <br />Expenditure Delay Services and Expense Delay Services. Mr. Creighton feels <br />that the Commission should still issue the fine, because Group W is in violation <br />of the franchise. He said that the question is the amount of the fine. <br />Mr. Creighton contacted some consultants concerning the fine. They felt the <br />Commission should fine Group W to make them build the system. Mr. Creighton <br />said that Group W could have saved $902,280 in year one for not completing <br />the system. <br /> <br />Mr. Dulgar questioned if we have lost Tier 3. Terry O'Connell said that it <br />hasn't been made yet, but Tier 3 was not lost. The system needs an interactive <br />computer and it won't be available until Zenith has the equipment. <br /> <br />Mr. Creighton said duetothe delay of construction in Ramsey and lack of access <br />equipment, the Commission should fine Group W $2,000/day from June regarding <br />the access equipment and $2,000/day from September 12 until construction of <br />the system is complete. <br /> <br /> <br />
