Refusal <br />of the applicant shall constitute denial of the plans by the city <br />council, Failure of the land owner to notify the city council of <br />bis acceptance or refusal of the conditions to the plan constitutes <br />acceptance of the conditions. <br /> <br />FINAL I)IJVELOPMENT PLAN PROCZDUt~ <br /> <br />Within six (6) mo, ths follow~ng the approval of the preliminary develop- <br />ment plan, the applicant shall file with the zoning officer a final <br />development plan containing in final form the information required in <br />the preliminary plan. The city council, at its discretion, may extend <br />for six (6) months the period for filing of the final development pla,.' <br /> <br /> 1. The zoning officer shall send a reproducible print and <br />one (l) other print to the chairman of the city planning commission. <br />If the planning commission finds that the final plan is in substaDtial <br />compliance with the plan given preliminary approval, it shall endorse <br />the plan and submit it to the city council within thirty (30) ~ays. <br /> <br /> 2. A public hearing on an application for final approval of <br />~he plan o¥ part thereof shall not be required, provided that the plan <br />is in substantial compliance with the plan given preliminary approval, <br /> <br /> 3. In ~he event the plan, as submitted for final approval, <br />is not In substantial compliance with the preliminary pleD, the city <br />.council shall notify the applicant within forty-five (45) days of the <br />date of applicatio, setting forth the ways in which'the Plan ia not ~ <br />s.bstantial compliance. <br /> <br />Tile applicant may treat snch notification as denla~ <br />of final approval; or <br />~e applicant may refile his plan so that it does <br />substantially comply with the preliminary plan; or <br />Tl~e applicant may file a written request with the <br />city council thab it hold a public hearing on his <br />[eqnest for final approval. Any such hearing shall <br />be held within thirty (30) days after the request <br />for such a hearing. Within forty-five (45) days <br />of such hearing, the city council shall eithmr <br />grant final approval or deny final approval to <br />the plan. <br /> <br /> 4.
