Refusal of the applicant shall constitute denial of the plans by the city council, Failure of the land owner to notify the city council of bis acceptance or refusal of the conditions to the plan constitutes acceptance of the conditions. FINAL I)IJVELOPMENT PLAN PROCZDUt~ Within six (6) mo, ths follow~ng the approval of the preliminary develop- ment plan, the applicant shall file with the zoning officer a final development plan containing in final form the information required in the preliminary plan. The city council, at its discretion, may extend for six (6) months the period for filing of the final development pla,.' 1. The zoning officer shall send a reproducible print and one (l) other print to the chairman of the city planning commission. If the planning commission finds that the final plan is in substaDtial compliance with the plan given preliminary approval, it shall endorse the plan and submit it to the city council within thirty (30) ~ays. 2. A public hearing on an application for final approval of ~he plan o¥ part thereof shall not be required, provided that the plan is in substantial compliance with the plan given preliminary approval, 3. In ~he event the plan, as submitted for final approval, is not In substantial compliance with the preliminary pleD, the city .council shall notify the applicant within forty-five (45) days of the date of applicatio, setting forth the ways in which'the Plan ia not ~ s.bstantial compliance. Tile applicant may treat snch notification as denla~ of final approval; or ~e applicant may refile his plan so that it does substantially comply with the preliminary plan; or Tl~e applicant may file a written request with the city council thab it hold a public hearing on his [eqnest for final approval. Any such hearing shall be held within thirty (30) days after the request for such a hearing. Within forty-five (45) days of such hearing, the city council shall eithmr grant final approval or deny final approval to the plan. 4.
