Subsection 6. The licensee and the owner of the site or facility and any ~.~--cessor in <br />Interest shall be responsible for the post-closure termination of the ~ite. The post-closure <br />period mSall commence upon expiration of the closure period and continue for a period of <br />twenty (20) years for sites or facilities initially licensed after October I, 1983. S~bject to <br />the provisions of Subparagraph IH, the past-closure period_ shall continue for a period of five <br />(S) years for sites or facilities inltialiy licensed prior to October I, 1~)83 ams which have not <br />received approval from the County m having completed closure requirements prior to <br />October I, 1983. In addition to the requlrernents established by the State of Minnesota, the <br />Metropolitan Council, the apprc~ved past-closure plan~ the license conditions established by <br />the County 13oard, and any other duties iml:x~-d by law, the following actions shall be taken <br />by the licensee and the owner and any successor in Interest during 1'ne past-clasure period, <br />unless otherwi~e specified by the County 13oarcl. <br /> <br /> A. The landfill shall be inspected during.the months of April and September of each <br /> year. Such Inspections shall evaluate leochate generation, soil erosion, <br /> sedimentation, vegetative cover nx~tntenance, ground ~ater monitoring wells~ <br /> soil gas monitoring probes, gas migration control equipments and site security to <br /> determine their condition. The County may reduce the number of inspections <br /> required if fewer ore needed. <br /> <br /> Conduct a water monitoring program meeting the standards set forth in the <br /> "Policy and Procedures For Landfill Water Monitoring" adopted by the Anoka <br /> County 13oord of Commissioners in its meeting of May 26, 1~81. During the first <br /> five (5) years after the site or facility ceases to accept waste the samples shall <br /> be collected quarterly as outlined in the palicy. During the second five (5) years <br /> the sampling frequency may be reduced to three (3) times a year, (April, Aucjust, <br /> and December). During the third five (S) years the sampling frequer~-'y may be <br /> reduced to two (2) times a year (April and October). During the fourth five (5) <br /> years the sc~Loling frequency may be reduced to once per year (July). Said <br /> sampling reduction may be allowed only if the data indicates no increasing <br /> leochate impact ~xl the reduction is approved by the Caunty. <br /> <br /> C. Methane gas germration and migration shall be tested at least every six (~) <br /> months, and rnore frequently if necessary, and records of the results of such <br /> tests shall be maintained and submitted to the Dep~tment. <br /> <br /> D. The final c~ver of the landfill shall be maintained in accordance with th~ <br /> approved pl6ns and solid waste ordinance. In the event that gullying or erosion <br /> occurs~ additional ecmthen material shall be placed crud compacted and measures <br /> shall be taken to prevent further occurrence of erosion. <br /> <br /> E. The turf shall be maintained in accordance with the approved plans and solid <br /> waste ordinance. E)eod or diseased vegetation shall be replaced and <br /> modificatiar, s of the turf shall be instituted as necessary to ensure the growth <br /> and maintenance of adequate turf on the landfill. <br /> <br /> F. All equipment, monitoring probes ~ wells and fencing shall be repaired if. <br /> necessary. Corrective action shall be taken to prevent adverse effects from gas <br /> and le~chate production. All site maintenance, rnonitoring~ and restorative: <br /> actio~ shall be completed within thirty (30) days following the inspection due <br /> date throughout the post-closure period. <br /> <br /> C~. A report describing the inspection, condltio+ls, corrective actions, and monitoring <br /> activities Perfo~rned in connection with the landfill shall be prepared and <br /> transmitted to the Department within thirty (30) days following the inspection <br /> due date. Said report shall be considered as notification that the site is in <br /> compliance with license canditions, the Past-closure plan~ and the solid waste <br /> ordJn~'x:e arKI that the County may inspect the site to verify said conditions. <br /> Inspections conducted by the County for such verification or correction of <br /> problems shall be at the expense of the owner or the operator or both. <br /> <br /> For mites or facilities with a five (S) year post-closure period, the County 13oard <br /> may extend the duties created under this subsection for up to an additior~ol ten <br /> (i0) years as reasonably necessary to correct and/or monitor problems with <br /> leachate, methane, turf or final cover. A problem exists with leochate or <br /> methane if the monitoring data does not indicate a significant decrease in <br /> leachate impact or methane cjeneration. <br /> <br />-12- <br /> <br /> <br />
