1/20/04 Conversation with Bruce Bacon (City Forester)
I contacted Bruce Bacon and asked him if he gave Mr. Bauer direction on the
alignment and width of the driveway that was put in as he was working with Mr.
Bauer prior to the staking of the road. He said that he gave Mr. Bauer no
recommendation as to width or alignment, and that he only gave Mr. Bauer ideas
and information as to types of trees and the health of the trees. NOTE: I wasn't
asked to accompany Mr. Bacon and Mr. Bauer during this time, however, the
neighbor (Lori) did, and she is able to add more information as to what took place
during this time frame.
I asked Mr. Bacon why so many trees had to come out, and the driveway that was
cut in was more of a road. Mr. Bacon stated that Mr. Bauer was to supply him
with a tree inventory, however, he had not seen it as of yet. Mr. Bacon Said he
would go out and asses the road, (He wasn't aware that it had been cut yet)

1/27/04 Message From Mr. Bacon
Mr. Bacon left a message that he had been out to the site and he felt it was an
acceptable rough cut. He stated that Mr. Bauer didn't brush outside of the lines
and had nice gentle turns, and that Mr.~Bauer is going to top coat the road with
gravel as to not impact the root structure. Mr. Bacon stated that his supervisor
(Gloria Frolic) said if the City was going to put in an improved road that they
would clear all of the trees. Mr. Bacon also stated that he had taken pictures
during his evaluation, but hadn't taken any before the cutting was done.
I returned Mr. Bacon's call and told him I needed to discuss this further.

1/28/04 Conversation with Mr. Bacon
I relayed my displeasure with the City's indifference toward the impact on the
existing residents and that Sylvia's comments were insensitive and inappropriate
given the circumstances. I relayed to Mr. Bacon that all parties should have been
involved in the walk through process prior to the road being staked out. He
agreed and apologized and stated that when this situation develops in the future,
he will have all affected parties involved. I asked him if he had gotten that tree
inventory from Mr. Bauer. He hadn't.

2/2/04

Conversation with Pat Trudgeon
Called Mr. Trudgeon to get updated as to progress. He relayed that the City
Attorney is having difficulty in locating the easement and any rights that the city
.may have to it. He will have more information in a couple of days. I asked Mr.
Trudgeon why Mr. Bauer cut that road in with out a permit. He stated that the
City had given him permission to do so.

2/5/04

Conversation with Pat Trudgeon
Called Mr. Trudgeon to get an update and any possible determinations that they
had made. He relayed that the City Attorney couldn't find anything and that the
City is sending out for a "Title Commitment" and this will' determine once and
for all if the City has any easement rights across my property as well as the
neighbors. This process should take about one week.
