Mr. Schnelle agreed that the proposed resolution would be revised to <br />address the existing landfill site only. Mr. Schnelle further stated that <br />the time period can be addressed in the final agreement. <br /> <br />Council.consensus is to revise the last paragraph of the proposed resolution <br />as follows: <br /> <br />"Now, Therefore, be it resolved that the City of Ramsey hereby confirms <br /> its continued commitment to a cooperative effort for utilization of this <br /> resource." <br /> <br />Motion by Councilmember Sorteberg and seconded by Councilmember Reimann to <br />adopt Resolution #83-7 regarding provision of methane gas to C.A.P. and <br />Waltek, Inc., with the above mentioned corrections. (Please refer to resolution <br />file for Resolution #83-7). <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Sorteberg, Reimann, <br />Schlueter and Van Wagner. Voting No: None. <br /> <br />COUNCIL NEW BUSINESS <br /> <br />Case #1: Damage To Pro~er~ Caused By ~ty Snow Plow; Case Of Mr. James <br /> Acers, 8600 176th Avenue NW: <br /> <br />Mayor Gamec and Councilmember Reimann informed Mr. Acers that it has been <br />the policy that the City is not responsible for damage to anything that is <br />in the City right-of-way, such as Mr. Acers' decorative posts at the end of <br />his driveway. <br /> <br />Mr. Acers replied that he brought the matter to Council's attention because <br />he has lived in Ramsey for four years and this is the first time the snow plows <br />have damaged the posts at the end of his driveway, that the drivers were plowing <br />to far into the ditch and if the posts were not there they would have damaged <br />the culvert. Mr. Acers also informed Council that there are several obstructions <br />in the right-of-way along 176th, that the City should request all violators to <br />remove obstructions from City right-of-way in order to protect City equipment. <br />He also stated that the City could request public worksmen to exercise caution <br />when approaching driveways. <br /> <br />Mayor Gamec replied that the City would campaign to inform the public to remove <br />obstructions from the City right-of-way. <br /> <br />Motion by Councilmember Reimann and seconded by Councilmember Sorteberg to <br />disapprove of authorizing the City of Ramsey to replace the decorative post <br />located on driveway edge at Mr. Acer's residence at 8600 - 176th Avenue NW <br />that were damaged by the City's snow plow truck when plowing snow on Thursday, <br />December 30, 1982. Further, that an article be published in the "Ramsey <br />Resident" informing the public that the City is not responsible for damage <br />to articles that are in the City right-of-way. <br /> <br />Further Discussion: Mr. Schnelle recommended that Council direct Merle <br />Mevissen to prepare a list of those property owners with obstructions in the <br />City right-of-way. Councilmember Reimann noted that if any obstructions in <br />the City right-of-way cause damage to City equipment, the City will take <br />action to have the obstruction removed.
