10 Minutes CASE ~3: <br /> <br />Background: <br /> <br />REQUEST FOR CONDITIONAL USE PERMIT TO MOVE IN RESIDENTIAL <br /> GARAGE FOR COMMERCIAL USE IN B-1 BUSINESS DISTRICT; <br /> CASE OF BERNDT DEVELOPMENT COMPANY, INC. <br /> By: Anne Norris, Community Development Director <br /> <br />Mr. Tom Berndt of Berndt Development Company, Inc. is requesting a conditional <br />use permit to move in a residential garage to be used for commercial activities <br />at 6159 Highway #10 NW. Mr. Berndt is proposing to move a garage <br />(approximately 14' x 22') presently located at 6316 - 74th Avenue North in <br />Brooklyn Park. Mr. Berndt is proposing to tear down the existing garage on the <br />property at 6159 Highway ~i0 NW. The building would be used for preparing <br />vehicles before they are put on the sales lot. <br /> <br />The Building Official inspected the building and has determined that it is <br />structurally sound. Photographs of the garage will be available at the meeting. <br /> <br />Enclosed for your information are the following items: <br /> <br />a) Application <br />b) Site location map <br />c) Public hearing notice <br />d) Properties notified <br />e) Proposed findings of fact <br />f) Proposed conditional use permit <br /> <br />Observations: <br /> <br />The Planning and Zoning Commission conducted a public hearing on this request <br />on October 7, 1986. The Commission recommended approval of Mr. Berndt's <br />request and recommended that if the proposed garage is not available, Mr. <br />Berndt be permitted to move in another garage if the Building Official inspects <br />the structure and finds it satisfactory and that the structure not exceed 24' x <br />24'. Also, the Commission recommended that no office or retail use be allowed <br />in the structure and that no salvage activities be conducted on the site. <br />Also, Mr. Berndt should be required to blacktop the driveway and off-street <br />parking areas. <br /> <br />Recommendation: <br /> <br />Council Action: <br /> <br />Motion to: <br />Adopt Findings of Fact 00 relating to a request for a conditional use <br />permit to move a residential garage into a B-1 Business District for <br />commercial use at 6159 Highway #10 NW. <br />-and- <br />Motion to: <br />Approve the request by Berndt Development Company for a conditional use <br />permit to move a residential garage into a B-1 Business District for <br />commercial use at 6159 Highway #10 NW. <br /> <br />Review Checklist: <br /> <br />Administrator <br />Attorney <br />Engineer <br />Community Development Director <br />Planning and Zoning Commission <br /> <br />Chief of Police <br />Finance Officer <br />Public Works Superintendent <br />Building Official <br /> <br /> <br />
