added cost could be passed onto the developer. <br /> <br />~he Commission also discussed the fact, that for a price, the City can <br />eliminate the long lead time of the newsletter and increase it's frequency. <br /> <br />Motion by Commissioner Lichter and seconded by Commissioner Heitman to <br />recommend that City Council recommend adding the following section to Charter <br />Chapter 8: 'Section 8.07. When a proposed improvement is petitioned for by <br />100% of the benefitted property owners, the Council may waive the procedures <br />defined in Section 8.05 of this Charter. However, a public hearing on the <br />improvement must be held, but only a 10 day notice is required after <br />publication in the City's official newspaper.' <br /> <br />Further Discussion: Commissioner Buchanan stated that the Charter Commission <br />put a lot of time and effort into the Charter and recommendations for <br />amendments should be given more time for consideration, examination, research <br />and alternatives. Commissioner Gamec stated that this motion will get the <br />recommendation on the floor, but there is still the opportunity for the people <br />to turn the recommendation around. Commissioner Buchanan stated that this <br />recommendations is creating a large loop hole; that all reasons for amending <br />this section are excellent but there also must be some negative reasons not <br />to, which should be explored. Commissioner Buchanan stated that this action <br />could potentially destroying a chapter that the Commission worked so hard to <br />get right. Commissioner Heitman stated that he too worked on the Charter and <br />has now had to work from that Charter as the Mayor and can appreciate some of <br />the problems Mr. Gamec was confronted with. Commissioner heitman stated that <br />a problem has been created which can be solved the recommendation in this <br />motion. Commissioner Lichter stated that he and Commissioner Data are now on <br />the firing line in regards to storm sewer improvements proposed for Watershed <br />District #43 and the change proposed in this motion will not affect their <br />situation. Commissioner Heitman stated that he feels confident that <br />CoF~issioner Greenberg would have no objection to this proposed amendment to <br />the Charter. Commissioner Heitman request a call for vote. <br /> <br />Chairman Sieber called for a roll call vote. <br /> <br />Commissioner Gamec - Aye. <br /> <br />Commissioner Bauerkemper - Aye. <br /> <br />Commissioner Lichter - Aye. <br /> <br />Commissioner Buchanan - Naye. Commissioner Buchanan stated his reason <br />for a 'naye' vote as this Commission worked on this Charter for over <br />one year and this recommendation was made in haste. <br /> <br />Commissioner Heitman stated that he remembers all of the arguments raised <br />when this chapter was written but added that-he now has additional <br />information to work with. <br /> <br />Commissioner Buchanan stated that he has serious doubts that Council will <br />adopt this recommendation unanimously.
