C/September 10, 1984 <br />motion took quite a while to complete. <br /> <br />Councilmember Van Wagner agreed. <br /> <br />Mr. Fountain proceeded to read excerpts from past Council <br />minutes. <br /> <br />May 27, 1980 - "Councilman Cox noted that things are <br />occurring at the landfill and the people around it have <br />sludge and water ponding and the County is monitoring it. <br />He suggested sending a letter to Mr. Ed Fields regarding <br />the City's disappointment in the County's response to <br />ordinance violations, in particular Waste Management's." <br /> <br />August 15, 1980 - "Councilman Cox said every time they <br />approach this problem, it is like starting from scratch." <br />"Councilman Cox said he though Waste Management had a much <br />greater degree of responsibility in the area because all <br />these aspects have made the residential homes there non- <br />marketable. He said he felt mismanagement had caused the <br />problem and the solution is much greater than just taking <br />care of the problem which is the result of the <br />mismanagement." <br /> <br />Mr. Fountain stated that as elected representatives of the City, <br />this Council's right and constitutional duty is to protect rights <br />of citizens and restore what Councilman Cox said on April 30, <br />1979 -- "It is about time the credibility and accountability come <br />back to government. The people deserve answers." Mr. Fountain <br />stated that Waste Management of Minnesota, Inc. deserves some <br />answers and Council should not table action on this case any <br />longer. Mr. Fountain stated that Council should not violate the <br />very reason Ramsey organized into a City -- to gain some control <br />over the landfill. Expansion has been discussed since 1980 and <br />nm is the time to put it to sleep. <br /> <br />Mr. James Reichert- Coale, Reichert and Sand/Attorneys at Law - <br />Stated that his office has been retained by homeowners who have <br />suffered damages because of the present landfill. Mr. Reichert <br />stated that homeowners in the surrounding area have already <br />suffered devaluation of their property as a result of the <br />landfill being located next to them. This detrimental effect <br />has been documented in several instances in their inability to <br />sell. Based on this documented unmarketability of present <br />property surrounding landfill, assessed valuations overstate the <br />value of that property. Property owners expect that new <br />appraisals will result in greatly reduced property taxes. <br />Newspaper articles have been published regarding surrounding <br />property devaluation because of landfills. The seriousness is <br />documented by PCA's placing the present landfill on their <br />priority list for cleanup funding. The present damage will be <br />compounded by any expansion of the landfill. Property owners <br />will take whatever action is necessary to prevent the expansion. <br />The power to prevent further damage to these surrounding <br />properties as well as others, rests in Council's hands.
