Councilmember introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION ~93-09- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE <br />PERMIT FOR AN ACCESSORY APARTMENT IN A SINGLE FAMILY <br />STRUCTURE IN THE R-! RURAL RESIDENTIAL <br /> <br /> WHEREAS, Curt/ss and Titterud have properly applied for a conditional use <br />permit (hereinafter referred to as "Permit") to ruaintain an accessory apartment within the single <br />family dwelling in the R-1 Rural Residential District on the property generally known as 6865 <br />162nd Lane N.W. and legally described as follows: <br /> <br />That part of the east half of the Northwest'Quarter of Section 15, Township 32, Range 25, <br />Anoka County, Minnesota, described as follows: Commencing at a point on the West line <br />of the east half of the Northwest Quarter a distance of 1,356 feet north of the Southwest <br />coruer thereof. Then south 80 degrees 48 minutes east 80.61 feet then south 47 degrees 32 <br />minutes east 260.25 feet then south 5 degrees 11 minutes east 282.5 feet then north 89 <br />degrees 38 minutes east 191,47 feet to actual point of beginning of u'act to be described, <br />then north 0 degrees 22 minutes west 199.27 feet then north 40 degrees 1 minute 24 <br />seconds east 222.56 feet to a point bearing south 49 degrees 58 minutes 36 seconds east <br />315.08 feet from a point 390 feet east of the west line and 175 feet south of the north line <br />of the east half of the Northwest Quarter. Then south 49 degrees 58 minutes 36 seconds <br />west 161.42 feet then south 30 degrees 22 minutes 47 seconds west 307.4 feet then south <br />89 degrees 38 minutes west 110 feet to actual point of beginning. For purposes of this <br />description, the south line of said Northwest Quarter is assnmed to bear north 89 degrees <br />38 minutes east_ <br /> <br /> WHEREAS, the Planning and Zoning Commission met on September 7, 1993, <br />conducted the public hearing and recommended City Council approval of the request. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact # ., a conditional use permit for an accessory apartment <br />within the single family dwelling unit is hereby granted to Curfiss and Titterud, <br />hereinafter referred to as "Permit Holder", at 6865 162nd Lane N.W., hereinafter referred <br />to as the "Subject Property". <br /> <br />o <br /> <br />That said Permit shall remain in effect so long as the conditions imposed herein are <br />complied with or the Permit Holder ceases ownership of the Subject Property. <br /> <br />o <br /> <br />That the maintenance of an accessory apartment within the single family dwelling structure <br />is approved so long as the occupancy of the main level is on a seasonal basis not to exceed <br />seven (7) months per year. <br /> <br />That the structure exterior shall maintain the appearance of a single family dwelling unit. <br />That the structure shall not be sold as a duplex or the accessory apartment as a <br />condominium. <br /> <br />That the accessory apartment shall be restricted to a one bedroom unit on the lower level of <br />the structure and is approved for occupancy by a maximum of two persons. <br /> <br /> <br />
