Unit 51 could be moved a few feet, but the simplest solution may be to move the sidewalk to the <br />other side of the road. He indicated for the NE building, the best solution is to widen the street <br />four feet so it meets the parking requirements. He noted that is the comer where Mn/Dot wants a <br />turn lane, but they had put the pond there to get the houses off Highway 10. He stated he does <br />not know how they can put up a 15 foot noise wall, and he thought the requirement was five feet. <br /> <br />Associate Planner Wald stated Mn/Dot's policy is they will not take responsibility for noise <br />complaints, and will not put funding into noise mitigation. She indicated it is the City's <br />responsibility. She agreed a 15 foot noise wall does not seem reasonable, but Staff needs more <br />time to address this situation. <br /> <br />Chairperson Nixt indicated they could get creative with landscaping that would not be a problem <br />for Highway 10 and would still mitigate the noise. <br /> <br />Associate Planner Wald stated they could, and there are also design elements such as windows <br />for the townhomes that would help mitigate the noise. <br /> <br />Chairperson Nixt asked if the Planning Commission would see this again. <br /> <br />Associate Planner Wald stated this is preliminary plat and site plan review, noting she did them <br />as one case since they were so intertwined. <br /> <br />Commissioner Johnson noted this development is being done under a PUD, which includes the <br />area intended to have mixed-use. Commissioner Johnson asked if there is agreement on what the <br />rest of the PUD will include. He questioned if the Code currently says it must be at least 70% <br />residential, what prevents the developer from developing the remainder of the property. <br /> <br />Associate Planner Wald indicated Staff would like to define that in the Development Agreement, <br />and the developer has made it clear that is his intent. <br /> <br />Commissioner Johnson asked that the wording be quite specific. <br /> <br />Mr. Shulte stated he always expected this would be commercial, and he intends to finish it with <br />commercial. He noted the two acres on the west end are still zoned B-2. He advised he is <br />talking with two major drug store chains about the property, and with the new stop light and <br />more residential in the area it should help. He indicated there is a bank he has a purchase <br />agreement with, and is talking with a large grocery store. He stated putting the signal in made a <br />big difference, and he definitely intends to put commercial along the parcel. <br /> <br />Chairperson Nixt indicated they have not focused on the architectural standards, and the Staff <br />Letter just says they look good. He asked if the plans meet the standards. <br /> <br />Associate Planner Wald stated they greatly exceed the architectural requirements.
