Improvements which respective definitions are used herein when reference is made to "Stage I" and "Stage II" Improvements; and WHEREAS, the DEVELOPERS desire to constuct the Stage I and Stage I1 improvements, except for those Stage I1 Improvements constructed by the CITY. NOW, THEREFORE, the CITY and DEVELOPERS agree as follows: STAGE I IMPROVEMENTS AND FINANCIAL GUARANTEES: City Code Compliance. That the DEVELOPERS will develop the Plat in accordance with the City Code, Section 9.50, entitled "Subdivision. (~onformance with Plan. The Plat shall be developed pursuant to the final plat consisting of two (2) sheets, prepared by Hakanson Anderson Associates, Inc., entitled Amber Ridge and received by the CITY on April 9, 1993. lncorporalion of' All ~it~' (.?.ode Requirements. That the recitals above and the provisions of the City Charter, Subdivision Code, Zoning Code and Public Improvement Code of the CITY, as amended to date hereof, are incorporated herein by reference. Stage I lm_vrovements Reouired. The DEVELOPERS agree to construct the required Stage I Improvements according to the terms and conditions of this contract and in accordance with DEVELOPERS' plans submitted to the CITY. Said plans shall be in general conformance with the Grading Plan prepared by Hakanson Anderson Associates, Inc. and last revised April, 1993. The final construction plan for sanitary sewer, storm sewer, watermain, and street improvements shall be submitted to the City Engineer for review and approval prior to construction. The DEVELOPERS shall also be responsible, at its expense, for installation of gas, telephone, and electric utiity improvements, with the exception of street lights. The DEVELOPERS shall be responsible for completing the rough grading and providing lot corner stakes prior to the installation of underground utilities. ,. o Access To T.H. #47. The DEVELOPER shall make application to the Minnesota Department of Transportation, obtain all permits, and pay all fees associated with the access of 147th Circle N.W. onto Trunk Highway #47.
