Improvements which respective definitions are used herein when reference is made to "Stage I" <br />and "Stage II" Improvements; and <br /> WHEREAS, the DEVELOPERS desire to constuct the Stage I and Stage I1 <br />improvements, except for those Stage I1 Improvements constructed by the CITY. <br /> NOW, THEREFORE, the CITY and DEVELOPERS agree as follows: <br /> <br />STAGE I IMPROVEMENTS AND FINANCIAL GUARANTEES: <br /> <br />City Code Compliance. That the DEVELOPERS will develop the Plat in accordance <br />with the City Code, Section 9.50, entitled "Subdivision. <br /> <br />(~onformance with Plan. The Plat shall be developed pursuant to the final plat <br />consisting of two (2) sheets, prepared by Hakanson Anderson Associates, Inc., entitled <br />Amber Ridge and received by the CITY on April 9, 1993. <br /> <br />lncorporalion of' All ~it~' (.?.ode Requirements. That the recitals above and the <br />provisions of the City Charter, Subdivision Code, Zoning Code and Public Improvement <br />Code of the CITY, as amended to date hereof, are incorporated herein by reference. <br /> <br />Stage I lm_vrovements Reouired. The DEVELOPERS agree to construct the <br />required Stage I Improvements according to the terms and conditions of this contract and in <br />accordance with DEVELOPERS' plans submitted to the CITY. Said plans shall be in <br />general conformance with the Grading Plan prepared by Hakanson Anderson Associates, <br />Inc. and last revised April, 1993. The final construction plan for sanitary sewer, storm <br />sewer, watermain, and street improvements shall be submitted to the City Engineer for <br />review and approval prior to construction. The DEVELOPERS shall also be responsible, <br />at its expense, for installation of gas, telephone, and electric utiity improvements, with the <br />exception of street lights. The DEVELOPERS shall be responsible for completing the <br />rough grading and providing lot corner stakes prior to the installation of underground <br />utilities. ,. <br /> <br />o <br /> <br />Access To T.H. #47. The DEVELOPER shall make application to the Minnesota <br />Department of Transportation, obtain all permits, and pay all fees associated with the access <br />of 147th Circle N.W. onto Trunk Highway #47. <br /> <br /> <br />
