I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br />I <br /> I <br /> <br /> ! <br /> CASE # · ~l~ <br /> <br />INTRODUCE PROPOSED ORDINANCE TO ESTABLISH REGULATIONS FOR <br />MOVING STRUCTURES INTO AND WITHIN THE CITY OF RAMSEY <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />As you may recall, a subcommittee of members of the City Council and the Planning and Zoning <br />Commission was formed to work on the issue of accessory uses and buildings. That <br />subcommittee consisted of the following persons: Mayor Gilbertson, Councilmembers <br />Zimmerman and Hardin, Planning Commission Chairperson Bawden, and Commissioners <br />Hendriksen and Deemer. That subcommittee also took on the task of establishing regulations for <br />moving structures into or within the City of Ramsey. at the last workshop meeting of the City <br />Council/Planning and Zoning Commission Subcommittee, Staff was directed to draft an ordinance <br />to prohibit the moving of structures into and within the City. Staff discussed this direction with the <br />City Attorney and he advised against absolute prohibition as it could be challenged as <br />discriminatory. City Attorney Goodrich stated that establishing stringent regulations for moving in <br />structures can provide the protection the City desires without being discriminatory. <br /> <br />Observations: <br /> <br />Upon the advice of City Attorney William Goodrich, the subcommittee chose to draft an ordinance <br />to establish stringent regulations for moving structures into or within Ramsey, rather than using <br />absolute prohibition which could be challenged as discriminatory. <br /> <br />The draft ordinance was reviewed by the subcommittee on September 7. (It should be noted that <br />the 3 councilmembers on the subcommittee were not present at that meeting). The consensus of <br />those members present was that the ordinance should do the following: <br /> <br />a) <br /> <br />Allow accessory structures (garages, storage sheds) to be moved into or within the <br />City with a building permit. <br /> <br />b) <br /> <br />Require a building moving permit for homes'to be moved into or within Ramsey. <br />The building moving permit does require a review by the Planning Commission and <br />approval of City Council. Approval would be based on, but not limited to, building <br />architecture, style, age, construction materials, and valuation. An approved <br />building moving permit will require the applicant to post a financial guarantee to <br />ensure proper completion of the project. The amount of the financial guarantee <br />would be determined on a case by case basis. <br /> <br />Recommendation: <br /> <br />City Staff recommends introduction of the ordinance, which is enclosed for review. <br /> <br />Council Action: <br /> <br />Motion to: <br />Introduce Ordinance g93- amending Chapter 8 of the Ramsey City Code to establish <br />regulations for moving structures into or within the City of Ramsey. <br /> <br />Review Checklist: <br /> <br />City Administrator <br />C~ty Attorney <br />Finance Officer <br />City Building Official <br /> <br />CC: <br /> <br />9/28/93 <br /> <br /> <br />
