Absent: Commissioner <br />Howell. <br /> <br />Motion by Commissioner Hendriksen and seconded by Commissioner Terry to add <br />the following condition to the proposed conditional use permit. <br /> <br />19. <br /> <br />That in the event Atlas' manufacturing facility ceases to <br />operate, the conditional use permit for the contract burn <br />facility will also cease. Further, that the building permit for <br />the contract burn portion of the project will not be issued <br />unless the manufacturing plan is being or has been constructed. <br /> <br />Motion carried. Absent: Commissioner <br />Howel 1. <br /> <br />Motion by Commissioner Holm and seconded by Commissioner Shumway to add the <br />following condition to the proposed conditional use permit: <br /> <br />20. <br /> <br />The types and amount percentages of waste to be burned at the <br />site shall be in accordance with the following schedule on <br />a bi-annual basis: <br /> <br />10% Cardboard, floor sweepings, paper, wood <br />15% Wood scraps, industrial trash <br /> 5% Refuse, garbage <br /> 5% Animal wastes, lab by-products <br /> 5% Pathological wastes <br />15% tars, paints, resins, solvents, sludges <br />15% Plastics, rubber, wood wastes <br />30% Hospital wastes including pathological and infectious <br /> <br />In the event the percentages vary by more than 30% per type bi- <br />bi-annually, this conditional use permit shall be reviewed by the <br />City of Ramsey. <br /> <br />Further Discussion: Commissioner LaDue stated that this condition is not <br />necessary ss Atlas is restricted to no hazardous waste and MPCA standards. <br />Mr. Labat requested that language be added to the condition to indicate <br />that if it appears there is a violation, U.S. EPA, MPCA or another <br />qualified outside expert, mutually agreeable to both parties, be requested <br />to assist in evaluating and recommending procedures to eliminate the <br />violation. Commissioner Hendriksen stated that there needs to be more <br />frequent revie~ of the permit if it appears there is a constant trend to <br />vary frcm the type and amount schedule. Mr. Val Carver stated that yearly <br />revi~s are good but to try and set a schedule for the amount of each type <br />of refuse to be burned is very difficult because nobody can predict the <br />trends trash will take. <br /> <br />Commissioner Holm restated his motion as follows: <br /> <br />Planning & Zoning Commission/June 23, 1988 <br /> <br />Page 8 of 12 <br /> <br /> <br />
