the City of Ramsey to pursue: <br /> <br />Alternative I - Enter into a Joint Powers Agreement with the City of Anoka, <br /> and County of Anoka. <br /> <br />Alternative II - Continue to try and work out an agreement with the City <br /> of Anoka only. <br /> <br />Alternative III - Commence lawsuit. <br /> <br />City Attorney Goodrich reviewed in detail, a draft of the Joint Powers <br />Agreement that could be entered into by the City of Ramsey, City of Anoka and <br />Anoka County. <br /> <br />Regarding Alternative I, City Attorney Goodrich stated that exact language <br />should be included in proposed agreement to the effect that said agreement <br />does not commit Ramsey to a landfill. <br /> <br />He further stated that this agreement does not require the City of Ramsey <br />to provide for Landfill II and that the landfill board does not go into effect <br />until Landfill II is initiated, which the County feels will take place in <br />July of 1982. He further stated that the County does not want to get involved <br />with the North 80 if there is not going to be a South 80. <br /> <br />Discussion ensued regarding the term "passive" found in Paragraph 1 of <br />County Responsibilities in Draft IV of the Joint Powers Agreement. <br /> <br />Council consensus is that the City should be aware of how County intends to <br />handle liability and that the County should disclose indemnity coverage. <br /> <br />Council recess at 9:20 p.m. <br /> <br />Mayor Gamec called the meeting back to order at 9:39 p.m. <br /> <br />City Attorney Goodrich stated that "net revenue" term utilized in Item IX <br />of Joint Powers Agreement should be better defined. <br /> <br />Regarding Item IX in Draft IV of the Joint Powers Agreement, Council consensus <br />is to eliminate the last sentence. <br /> <br />Council then discussed Alternative II (Continue to try and work out an agree- <br />ment with the City of Anoka.) <br /> <br />Council consensus is that there is too much friction between City of Ramsey <br />and City of Anoka to pursue Alternative II. <br /> <br />Councilmember Van Wagner stated that this special council meeting is the result <br />of City of Anoka's failure to comply with 1976 Agreement entered into by <br />City of Anoka and Ramsey. In her view, the proposed Joint Powers Agreement <br />does not win Ramsey anything with regards to the 1976 contract compliance <br />failure. <br /> <br />City Attorney Goodrich informed Councilmember Van Wagner that revenues being <br />collected from Landfill I are going into an interest bearing account until <br />such time as Ramsey continues an agreement with City of Anoka or upon <br />completion of a law suit. <br /> <br />Sp C/April 5, 1982 <br /> Page 3 <br /> <br /> <br />
