P & Z Commission advised Mr. Reinke to apply for a special use permit and <br />then proceed with a public hearing. Councilmember Cox stated that he <br />thought it was normal procedure to first approach City Council and they <br />would make their recommendation whether or not to proceed with P & Z public <br />hearing. Councilmember Cox further stated that Mr. Reinke's request to <br />operate a business from his home is in direct violation of City Ordinance <br />and he should not even have been advised to proceed with P & Z public hearing <br />process. <br /> <br />Mr. Schnelle stated that past experience has shown that the best way to go is <br />to have the citizen approach P & Z first and then Council, at which time <br />Council can express their opinion, but if you want us to bring these matters <br />to Council first, we can. Mr. Schnelle further stated that Mr. Reinke is <br />in operation, which is in violation of City Ordinance, and that he is scheduled <br />for a P & Z public hearing November.3, 1982. <br /> <br />Mayor Gamec stated that there are a great many zoning violations in existence <br />and there would be a minimum court fee on each violation of $200-$500. He <br />also stated that there is going to have to be a special Council meeting <br />held to determine how the City is going to proceed, how the City is going to <br />handle the cost and it will probably require hiring a full time person to <br />handle the matter of zoning violations. <br /> <br />Motion by Councilmember Sorteberg and seconded by Councilmember Cox to approve <br />the agenda with the addition of Mr. Terry Hendriksen's drainage problem. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cox, Sorteberg, <br />Reimann and Van Wagner. Voting No: None. <br /> <br />Motion by Councilmember Van Wagner and seconded by Councilmember Sorteberg to <br />approve Public hearing minutes and Board of Adjustment meeting minutes dated <br />September 28, 1982 regarding Mr. John Anderley's request for a larger <br />accessory building than City Code provides for. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Sorteberg, Reimann, <br />Cox and Van Wagner.
